NOTICE IS GIVEN that the Council of the City of Wolverhampton (“The Council”) being the appropriate Local Planning Authority has determined that the area described in the Schedule to this Notice is an area of special architectural or historic interest and that it is desirable to preserve or enhance its character or appearance. It has accordingly extended the St Philip’s (Penn Fields) Conservation Area so as to include the property detailed in the First Schedule to this Notice.

The principal effects of this area being included in the Conservation Area are as follows:—

  • 1 The Local Authority is under a general duty to ensure the preservation and enhancement of Conservation Areas and has a statutory duty to prepare proposals to that end (i.e. to prepare appraisals and management proposals);
  • 2 Notice must be given to the Local Authority before works are carried out to any tree (above a certain size) in the area;
  • 3 Conservation Area Consent is required for demolition of any unlisted building in the area and the Local Authority may take enforcement action or institute criminal prosecution if consent is not obtained;
  • 4 The details as to the limits of what works may be carried out without planning permission are somewhat different;
  • 5 Extra publicity is given to planning applications affecting Conservation Areas; and the Local Planning Authority is to take into account the desirability of preserving and enhancing the character of the area when determining such applications;
  • 6 Limited financial assistance may be available for the upkeep of buildings in Conservation Areas especially where an externally funded grant regime is in operation.
  • 7 The Local Authority may be able to take steps to ensure that a building in a Conservation Area is kept in good repair (note: normally only applies to neglected unoccupied buildings);
  • 8 The display of advertisements may be somewhat more restricted in Conservation Areas (note: applies to areas where there are properties in commercial use).
  • 9 Specific statutory duties are imposed on Telecommunications Operators (by virtue of licences granted under the Telecommunications Code 1984).
