TOWN AND COUNTRY PLANNING ACT 1990
THE SECRETARY OF STATE hereby gives notice that she has made an Order under Legislation section: Section 247 of the above Act entitled “The Stopping up of Highways (South West) (No. 18) Order 2012” authorising the stopping up of a length of Cookworthy Road commencing from its junction with Foliot Road at Plymouth, in the City of Plymouth to enable the development described in the Schedule to this notice to be carried out in accordance with the planning permission granted to Barratt Homes Exeter by Plymouth City Council on 5 December 2011 under reference 11/01384/REM.
COPIES OF THE ORDER MAY BE OBTAINED, free of charge, on application to the Secretary of State, addressed to the National Transport Casework Team, 2nd Floor, Lancaster House, Hampshire Court, Newcastle Business Park, Newcastle upon Tyne, NE4 7YH (quoting reference NATTRAN/SW/S247/420) and may be inspected at all reasonable hours at North Prospect Library, Wolseley Road, Plymouth, Devon, PL2 3JQ .
ANY PERSON AGGRIEVED BY THE ORDER and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of the 28 June 2012 apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.

THE SCHEDULE
Reserved matters planning permission is granted for (access, appearance, landscaping, layout and scale) for the erection of 26 houses and 5 flats and the erection of a community hub building with mixed uses including multi-use community hall, retail, nursery and office space with 58 flats above and public open space (demolition of existing buildings including school, flats and associated garages) at North Prospect Road, Plymouth .
