  • 1 NOTICE IS HEREBY GIVEN that the Council of the London Borough of Brent have made the above-mentioned Orders under sections 6, 45, 46, 49 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984, as amended by section 8 of and Part 1 of Schedule 5 to the Local Government Act 1985, the Parking Acts of 1986 and 1989 and the Traffic Management Act 2004.
  • 2 The general effect of the ‘parking places’ Orders will be to:
    • a revoke the existing business permit holders only parking places outside Nos. 69/71 and 65 Wembley Hill Road;
    • b revoke the shared use parking places outside Nos. 85/87 and 73 to 77 Wembley Hill Road;
    • c provide new business permit only parking places outside Nos. 69/71 and 53 to 63 Cottrell House, Wembley Hill Road and in Dagmar Avenue adjacent to No. 65 Wembley Hill Road;
    • d provide new shared use parking places outside Nos. 73 to 77 and 85 to 91 Wembley Hill Road and in Dagmar Avenue adjacent to No. 65 Wembley Hill Road; and
    • e redefine the existing disabled person parking place adjacent to No. 91 Wembley Hill Road.
  • 3 The general effect of the 'Waiting and Loading Restrictions' Order will be further to amend the Brent (Waiting and Loading Restriction) Order 1979, so that:—
    • a waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be prohibited at any time in the lengths of streets specified in Schedule 1 to this Notice;
    • b waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be prohibited between 8.00 a.m. and 9.00 p.m. throughout the week in the lengths of streets specified in Schedule 2 to this Notice;
    • c waiting by vehicles for the purpose of delivering or collecting goods or loading or unloading a vehicle for a period of more than 20 minutes in the same place will be prohibited between 11.00 a.m. and 6.30 p.m. throughout the week in the lengths of streets specified in Schedules 1 and 2 to this Notice
    • d the sale or offer for sale of goods from a vehicle will be prohibited (except on Sundays in the lengths of streets specified in Schedules 1 and 2) unless there is in force a valid licence issued by the Brent Borough Council or the goods are immediately taken into or delivered at premises adjacent to the vehicle from which the sale is effected;
    • e the use of any vehicle or of any animal or the wearing of fancy dress or other costume, wholly or mainly for the purpose of advertising will be prohibited;
    • f any existing prohibition on the waiting by vehicles, the sale or offer for sale of goods from a vehicle or the use of any vehicle or animal or the wearing of fancy dress or other costume wholly or mainly for the purpose of advertising in the lengths of streets specified in Schedules 1 and 2 to this Notice will be revoked.
  • 4 The prohibitions referred to in sub-paragraph 3(a) and (b) above will not apply in respect of anything done with the permission or at the direction of a police constable in uniform or in certain circumstances, e.g., the picking up or setting down of passengers; the carrying out of statutory powers or duties; the taking in of petrol, etc., from roadside petrol stations; to licensed street traders, etc. The usual exemption relating to vehicles displaying a disabled person’s “Blue Badge” will apply.
  • 5 The general effect of the ‘Prescribed Routes’ Order will be to impose one-way working from south-east to north-west in Wembley Hill Road, which fronts Nos. 69 to 91Wembley Hill Road; between the north-eastern kerb-line of Dagmar Avenue and the south-western kerb-line of Wembley Hill Road, the northern arm.
  • 6 Copies of each of the Orders, which will come into operation on 5 December 2011, of a map of the relevant area, of the relevant Order of 1979, 1998 (and of the Orders which have amended those Orders) can be inspected during normal office hours on Mondays to Fridays inclusive until the end of six weeks from the date on which the Orders were made at:-
    • a The One Stop Shop, Brent Town Hall, Forty Lane, Wembley, Middx, HA9 9HX; and
    • b The One Stop Shop, Brent House, 349-357 High Road, Wembley, Middx, HA9 6BZ.
  • 7 Copies of the Order may be purchased from the address mentioned in paragraph 6(b) above.
  • 8 Any person desiring to question the validity of either of the Orders or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984 or that any of the relevant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to either of the Orders may, within six weeks of the date on which the Orders were made, make application for the purpose to the High Court.

SCHEDULE 1

Waiting restrictions (At any time)

Dagmar Avenue

  • a the north-east side, between the north-western kerb-line of Wembley Hill Road and a point 21.90 metres south-east of a point opposite the south-eastern building wall of No. 3 Dagmar Avenue;
  • b the south-west side, between the north-western kerb-line of Wembley Hill Road and a point 38.30 metres south-east of a point opposite the south-eastern building wall of No. 3 Dagmar Avenue.

Park Place, the south-east and south-west sides, between a point 5.00 metres south-west of the south-western kerb-line of Wembley Hill Road and a point 9.20 metres south-west of that kerb-line.

SCHEDULE 2

Waiting restrictions (8.00 a.m. and 9.00 p.m. throughout the week)

Dagmar Avenue

  • a the north-east side, between a point 21.90 metres south-east of a point opposite the south-eastern building wall of No. 3 Dagmar Avenue and a point 2.00 metres south-east of a point opposite the north-western wall of No. 163 Park Lane;
  • b the south-west side, between a point 38.30 metres south-east of a point opposite the south-eastern building wall of No. 3 Dagmar Avenue and a point 15.30 metres south-east of a point opposite the party wall of Nos. 76 and 78 Dagmar Avenue.
