ROAD TRAFFIC REGULATION ACT 1984
THE M4 MOTORWAY (LONDON BOROUGH OF HOUNSLOW) (SUSPENSION OF BUS LANE) (EXPERIMENTAL) ORDER 2010
THE SECRETARY OF STATE FOR TRANSPORT hereby gives notice that he made this Order under sections 9(1)(b) and (3) and 10(1) and (2) of the Legislation: Road Traffic Regulation Act 1984 on 8th November 2010, coming into force on 24th December 2010, on the M4 Motorway in the London Borough of Hounslow.
THE EFFECT of the Order would be to suspend the operation of the bus lane on the eastbound carriageway of the M4 between junction 3 and 2, between a point 19 metres east of marker post 21.8 and a point 12 metres west of marker post 16.0, a total distance of approximately 5780 metres. This would be an experimental period of up to eighteen months from the date the Order comes into force. Article 3 of the Order contains a provision under section 10(2) of the Act allowing a specified officer (in this case a Divisional Director of the Highways Agency, Dorking) to modify or suspend the operation of the Order or any provision of it if it appears to him essential in the interests of the expeditious, convenient and safe movement of traffic. The operation on this article is conditional on having consulted with the Commissioner of the Metropolitan Police and the giving of any public notices as required by the Secretary of State.
A COPY of the Order, of a plan illustrating its effect, of the Orders to be suspended and of a statement explaining why the Secretary of State has made the Order may be inspected during office hours at the offices of the London Borough of Hounslow, Civic Centre, Lampton Road, Hounslow, TW3 4DN and during opening hours at Chiswick Library, Duke’s Avenue, Hounslow, W4 2AB until 20th December 2010 . They may also be obtained by application to Network Delivery & Development, Highways Agency, Floor 4C, Federated House, London Road, Dorking, Surrey, RH4 1SZ, quoting the reference HA/M4/41/10/15.
ANY PERSON wishing to question the validity of the Order, or of any provision contained therein, on the ground that it is not within the powers of the above Act, or that a requirement of that Act, or of any relevant regulations made thereunder, has not been complied with, may, within six weeks from 8th November 2010, make application for the purpose to the High Court.
