THE EXTINGUISHMENT OF VEHICULAR RIGHTS (DOCK ROAD, VICTORIA DOCK, CAERNARFON, GWYNEDD) ORDER 2009

NOTICE IS HEREBY GIVEN that the Welsh Ministers have made an Order under Section 249 of the Town and Country Planning Act 1990 (“the Act”) to authorise, subject to certain exceptions listed in Schedule 2 to this Notice, the extinguishment of vehicular rights over the area of highway described in Schedule 1 to this Notice.

During the 6 weeks from 31 December 2009, copies of the Order and the deposited plan may be inspected free of charge at Gwynedd Council Planning Office, Penrallt, Caernarfon during normal office hours or may be obtained free of charge from the address below quoting the Welsh Assembly Government reference CZ510-5-44-qA748077/1. If any person desires to question the validity of the Order, or of any of the provisions contained therein, on the grounds:

a. that it is not within the powers of the Town and Country Planning Act 1990; or

b. that their interests have been substantially prejudiced by a failure to comply with any of the requirements of the Act,

that person may, within 6 weeks of 31 December 2009, apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.

Schedule 1

Description of the area of highway over which vehicular rights are to be extinguished under this Order.

That area of the highway known as Dock Street, which commences at its southern end at the Galeri service access (marked as ‘A’ on the deposited plan), follows the perimeter of the dock wall and ends at the Lôn Eifion Cycle Route to the north (marked as ‘B’ on the deposited plan), a length of approximately 340 metres.

Schedule 2

Cases where vehicles are permitted to use the highway described in Schedule 1 to this Order.

  • i For Police, Fire Brigade or Ambulance purposes.
  • ii On behalf of a statutory undertaker or public communications providers engaged upon the laying, erection, inspection, maintenance, alteration, repair, renewal or removal of any main, pipe, conduit, wire, cable or other apparatus for the supply of gas, water, electricity or telecommunications signal under, in, on, along or across the highways or any land adjacent to the highways.
  • iii In the service of a local authority in pursuance of statutory powers or duties.
  • iv For disabled persons vehicles within the meaning of the Local Authorities’ Traffic Orders (Exemption for Disabled Persons) (Wales) Regulations 2000.
  • v For service vehicles in respect of the dock (marina), pier and maritime vessel maintenance.
  • vi For vehicles loading any boat/ship on the pier.
  • vii For pedal cycles (part of the Lôn Eifion Cycle Route).
