TOWN AND COUNTRY PLANNING ACT 1990

THE SECRETARY OF STATE hereby gives notice that he has made an Order under Section 247 of the above Act entitled “The Stopping up of Highway (West Midlands) (No. 46) Order 2009” authorising the stopping up of a 145 metre south eastern part width of Meadows Way comprising highway verge and a 112 metre length of Craigside at Biddulph in the District of Staffordshire Moorlands to enable the development described in the Schedule to this notice to be carried out in accordance with planning permission granted to Sainsbury’s Supermarket Ltd and Biddulph Development by Staffordshire Moorlands District Council on 1 September 2009 under reference 08/01547/FUL_MJ.

COPIES OF THE ORDER MAY BE OBTAINED, free of charge, on application to the Secretary of State, addressed to the National Transport Casework Team, Government Office for the North East, Citygate, Gallowgate, Newcastle upon Tyne NE1 4WH (quoting reference NATTRAN/WM/S247/87) and may be inspected at all reasonable hours at Moorlands District Council, Moorlands House, Stockwell Street, Leek ST13 6HQ.

ANY PERSON AGGRIEVED BY THE ORDER and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of the 31 December 2009 apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.

Planning permission is granted for a retail food store (class A1), associated access, customer parking, service yard, recycling centre, 7 retail units (class A1-A5); 10 dwellings (class C3); offices (class B1); bus hub (Sui Generis) and associated highway, footpath and landscaping works at Sainsbury’s Wharf Road, Biddulph, Staffordshire Moorlands.
