TOWN AND COUNTRY PLANNING ACT 1990

THE SECRETARY OF STATE hereby gives notice that he has made an Order under Section 247 of the above Act entitled “The Stopping up of Highway (Yorkshire & The Humber) (No. 58) Order 2009” authorising the stopping up of a southern part width of Wakefield Road, commencing 5 metres east of the north eastern boundary of No 248 Wakefield Road, extending in an easterly direction for a distance of 23 metres and having a maximum width of 18 metres, at Drighlington in the City of Leeds to enable the development described in the Schedule to this notice to be carried out in accordance with outline planning permission granted under Part III of the Act to W H Bailey by Leeds City Council on 6 August 2008 under reference P/08/01763/OT and reserved matters approval granted to W H Bailey by Leeds City Council on 28 August 2009 under reference P/09/02836/RM.

COPIES OF THE ORDER MAY BE OBTAINED, free of charge, on application to the Secretary of State, addressed to the National Transport Casework Team, Government Office for the North East, Citygate, Gallowgate, Newcastle upon Tyne NE1 4WH (quoting reference NATTRAN/Y&H/S247/132) and may be inspected at all reasonable hours at Morley Library, Commercial Street, Morley, Leeds, LS27 8HZ .

ANY PERSON AGGRIEVED BY THE ORDER and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of the 29 December 2009 apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.
