TOWN AND COUNTRY PLANNING ACT 1990

THE COUNCIL OF THE LONDON BOROUGH OF SOUTHWARK hereby gives notice that it has made an order under section 247 of the above Act to authorise the stopping up of the following area of public highway:

  • 1 The three areas of public highway to be stopped up forming part of the footway of the highway known as Jamaica Road. The first area being an irregular rectangle shaped area to the north of Casby House. The second area being a thin pointed rectangle shaped area to the north-east of Darnay House. The third area being a long thin rectangle shaped area to the north-west of Lupin Point.

THE ORDER is to enable the development described in the Schedule to this notice to be carried out in accordance with the planning permission granted under Part III of the Act to Hyde Housing Association, 181 Lewisham High Street, London SE13 6AA by the Council of the London Borough of Southwark on 30 th March 2005 under reference LBS Reg. No 04-AP-0102 and also on 10 th June 2009 for the reserved matters application under references LBS Reg. 09-AP-0519.

COPIES OF THE ORDER AND THE RELEVANT PLANS MAY BE INSPECTED at all reasonable hours at the Town Hall Reception Desk, Peckham Road, London, SE5 8UB quoting reference LEG/PLA/134711(SH). ANY PERSON aggrieved by the Order and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any regulation made thereunder has not been complied with in relation to the Order may, within 6 weeks of 24 th December 2009, apply to the High Court for the suspension or quashing of the Order or of any provision contained therein..

Outline application for demolition of Carton, Giles & Darnay Houses & the redevelopment of all 5 sites to create a mixed-use development comprising a mix of 605 residential units, a Class A1 retail food store, Class D1 health centre & commercial unit for alternative Class A1/A2/B1 or D2 use, in new buildings between 3 & 10 storeys high; total of 217 new off-street car parking spaces (182 for residents & 35 for non-residential accommodation) together with all associated landscaping, infrastructure & ancillary development works pursuant to Outline Planning Permission 04-AP-0102.

Reserved Matters pursuant to Outline planning permission 04-AP-0102 dated 30/03/2005 being: External appearance, details of landscaping and other treatments including layout of any part of the site not covered by buildings, as well as the detailed design of the buildings including the internal layouts and access arrangements for Phases 3 and 4 which involve the erection of 7 buildings ranging in height from 3 to 10 storeys comprising 319 flats and a 1,395sqm supermarket (Use Class A1) and associated cafe (Use Class A3), 314sqm of other commercial space (Use Class A1, A2, A3, B1, and D2), 109 basement car parking spaces, and associated open space.
