PLANNING (LISTED BUILDINGS AND CONSERVATION AREAS) ACT 1990 (“THE 1990 ACT”), SECTION 69

BROCKENHURST CONSERVATION AREA

NOTICE IS HEREBY GIVEN under the provisions of the 1990 Act that New Forest National Park Authority (“the Authority”) has determined that the area described in the Schedule to this Notice is an area of special architectural or historic interest, and that it is desirable to preserve or enhance its character or appearance. Accordingly, on 29 October 2009, it amended the scope of Brockenhurst Conservation Area (formerly known as Brockenhurst (Waters Green).

The principal effects of the designation of this area as a conservation area are as follows:

  • 1 The Authority is under a duty to prepare proposals to ensure the preservation or enhancement of the area.
  • 2 The consent of the Authority must be obtained prior to the demolition of any building in the area.
  • 3 Additional publicity must be given to planning applications for development in the area.
  • 4 In carrying out any functions under the planning acts (and, in particular, in determining applications for planning permission and listed building consent), the Authority and the Secretary of State are required to take into account the desirability of preserving or enhancing the character or appearance of the area.
  • 5 Six weeks notice must be given to the Authority before works are carried out to any tree situated within the area.

Schedule

The boundaries are:

In a clockwise direction, from a point at the north eastern corner of the junction of the A337 Lyndhurst Road with the B3055 Balmer Lawn Road, east along the northern boundary of the B3055 to a point opposite the northwest corner of the boundary of the land of Little Balmer. South across the B3055 then south along the western boundary of the land of, but not including, Little Balmer to a point where the field boundary meets the Lymington River. South across the Lymington River and along the eastern boundary of the field to the east of the A337 and the boundary of the lands and including the land including Bridge Farmhouse, the electricity sub-station, Bridge Farm and the historic farm buildings at Bridge Farm, but not including the modern farm buildings and farmyard of Bridge Farm. Southeast along the eastern boundary of the field south of Bridge Farm and the boundary of the land and including land including Pittefaux Cottage and Careys Manor Hotel. Southwest, west and south along the north and western boundaries of the lands of Brockenhurst College including the land including The Lodge and the treed boundary along the eastern edge of the A337, but not including the buildings of Brockenhurst College. South, southeast, southwest along the boundary of the land and including land including Garlands Cottages and St Mary’s Cottage to a point where it joins North Road. Southeast along the north eastern boundary of North Road to a point opposite the northeast corner of the boundary of the land of The Rose and Crown Hotel, then south across North Road following the eastern and southern boundaries of the land of and including land including The Rose and Crown Hotel to a point where it meets the A337. South along the eastern boundary of the A337 to a point at the northwest corner of the boundary of the land of The Snake Catcher public house, then east along the boundary of the land and including land including The Snake Catcher public house. Southwest along the north western boundary of the railway track to a point on the northeast corner of the boundary of the lands of the Crossing Keeper’s Cottage, then southeast and southwest along the boundary of the land and including land including The Crossing Keeper’s Cottage. Southeast across the railway track to a point at the northern corner of the boundary of the land of Wisteria Cottage. Continuing southeast along the boundary of the land and including land including Wisteria Cottage, Next Door and Appletree Cottage to a point where the boundary joins Mill Lane. Northeast, east and north along the northern boundary of Mill Lane to a point opposite North Lodge, then northwest along the eastern boundary of Vinneys Close to a point where it meets the railway track, then northeast, southeast and southwest along the boundary of the land and including land including Thurstons Cottage. South across Mill Lane then southwest along the southern boundary of Mill Lane to a point where it meets the boundary of the land of North Lodge. Southwest, south, southwest and west along the boundary of the land and including land including North Lodge, then south and west along the boundary of the land and including land including Reynold’s Cottage. South along the eastern edge of the track leading to St Nicholas’ Church to a point where it meets the drive to Brockehurst Park. Continuing south, then southwest and west around the boundary of the car park for the church then northwest along the south western boundary of Church Lane to its junction with the A337 Lymington Road. West across the A337, then north along its western boundary to a point where it meets the boundary of the land of Marl Pool. West, north and east along the boundary of the land and including land including Marl Pool to a point where it joins the A337. North along the western edge of the A337 across the level crossing to the railway track to a point where it joins the boundary to the land of Morant Arms. Then southwest, northwest, west, northwest and northeast along the boundaries of the lands and including lands including Morant Arms, Cherry Tree Cottage, 7, 9, 13, 17 and 19 Brookley Road to a point where it meets Brookley Road. Northwest along the south western boundary of Brookley Road to a point where it meets the boundary of the lands of LloydsTSB Bank, then south and west around the boundary of the lands and including land including the Lloyds TSB Bank to a point where it meets Sway Road. West across Sway Road then south, west, south, west, south, west, south, west, south, west, south, west and southwest along the boundaries of the land and including the land including Fern Cottage, Rosetta Cottage, 23, 23a, 25, 27 and 31 Brookley Road and The Water Splash Hotel to a point where it meets The Rise. Southwest across The Rise then west following the southern boundary of The Rise to a point where it meets Burley Road. Southwest along the southern boundary of the wide verge of Burley Road to a point opposite Oak Cottage, then northwest across Burley Road, northeast to the southern boundary of the land of Green Oaks. Northwest, west, northwest, west, northwest and east along the boundaries of the land and including the land including Green Oaks, Baskerville, Bell House and Orchard House to a point where it meets Wilverley Road. Northwest, then northeast across Wilverley Road to the boundary of the land of Ford’s Grove. Northeast, northwest, northeast, northwest, southwest, northwest and north along the boundaries of the land and including land including Ford’s Grove, Brookley Magna, Fairhaven, Little Oaks, Thorndon, Reeds Cottage, Marden Cottage, Marden, South Marden, Crill, Herald Cottage, Westville, Te Whari, Hope Cottage, Coridon, Cleemont and Butts Mead to a point where it joins Rhinefield Road. West along the southern boundary of Rhinefield Road to a point where it meets the boundary of the land of Forest Park Hotel, then south, west and north following the boundary of the land and including land including Forest Park Hotel and Forest Park Stables to a point where Forest Park Road meets Rhinefield Road. North across Rhinefield Road, then east along the northern boundary of Rhinefield Road to a point where it meets the boundary of the land of Lea Cottage. North, east and south along the boundaries of the land and including land including Lea Cottage and Butts Cottage to a point where it meets Rhinefield Road. East along the northern boundary of Rhinefield Road to its junction with Meerut Road, then northeast along the north western boundary of Meerut road to a point opposite the junction with the access road to Careys Cottages. North along the western boundary of the A337 to a point with its junction with Waters Green, then west along the southern boundary of Waters Green to a point where it meets the boundary of the land of Bridge Cottage. Then south, southeast, south, west, south, west, south, northwest, north, northwest, southwest, northwest, north, northeast, northwest, northeast and northwest along the boundaries of the land including land including Bridge Cottage, Melrose Cottage, Chamberlains Cottage, 1 Chestnut Road, Field Head, Annerley, Nordons House and Oak Tree Cottages to a point where it meets the Ford at Waters Green. West and southwest around the northern end of Angel Valley to a point where it meets the southern corner of the boundary of the land of 11 Careys Cottages, then northwest, northeast, northwest, southwest, northwest, southwest and northwest along the boundaries of the land including land including 11 and 10 Careys Cottages, Thorn, Headington and Sunset Cottage to a point where it meets Meerut Road. Northwest across Meerut Road, then northeast along the northern boundary of Meerut Road to Bullhill Bridge, north along The Weir stream to a point where it meets Martin’s Road, then northeast and east along the footpath off Martin’s Road to a point where it meets the A337. North along the western boundary of the A337 over Brockenhurst Bridge to a point opposite the junction of the B3055 and the A337, then east across the A337 to the north eastern corner of the junction.
