STOPPING UP OF DURAND CLOSE

• 1 Notice is hereby given that the Council of the London Borough of Sutton (hereinafter referred to as “the Council”) has made an Order under section 247 of the Town and Country Planning Act 1990, entitled the London Borough of Sutton (Stopping-Up of Highway) (Durand Close) Order 2009, authorising the stopping-up of highway at Durand Close.
• 2 The Order as made will authorise the stopping-up only to enable the development described in the Schedule to this notice to be carried out in accordance with the planning permission granted by the Council on 7 August 2008 and 24 September 2008 under planning permission Ref Nos C2006/56803/OUT and C2008/60171/ARM.
• 3 A copy of the Order and the relevant plan may be obtained, free of charge, on application to the Council’s Interim Executive Head of Legal and Democratic Services, Civic Offices, St Nicholas Way, Sutton, Surrey SM1 1EA (Ref VCW) (020 8770 5193).
• 4 A copy of the Order and the relevant plan may be inspected by any person, free of charge, by appointment, between 10.00 am and 4.00 pm (weekdays) at Civic Offices, St Nicholas Way, Sutton, Surrey SM1 1EA.
• 5 Any person aggrieved by the Order and desiring to question the validity thereof, or of any provision contained therein, on the grounds that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may within 6 weeks of 15 October 2009 apply to the High Court for the suspension or quashing of the Order or of any provisions contained therein.
