THE SECRETARY OF STATE hereby gives notice that he has made an Order under Section 247 of the above Act entitled “The Stopping up of Highway (South West) (No. 17) Order 2009” authorising the stopping up of a north western part width of unnamed highway, comprising highway verge commencing from the junction of Hidonfields Stables and the unnamed highway and extending in a south westerly direction at Clayhidon in the District of Mid Devon to enable the development described in the Schedule to this notice to be carried out in accordance with planning permission granted to Kirkstone Properties Ltd by Mid Devon District Council on 27 June 2008 under reference 08/00328/FULL and on 10 October 2008 under reference 07/01807/FULL.

COPIES OF THE ORDER MAY BE OBTAINED, free of charge, on application to the Secretary of State, addressed to the National Transport Casework Team, Government Office for the North East, Citygate, Gallowgate, Newcastle upon Tyne NE1 4WH (quoting reference NATTRAN/SW/S247/57) and may be inspected at all reasonable hours at Cullompton Library, 2 Exeter Hill, Cullompton, Devon EX15 1DH.

ANY PERSON AGGRIEVED BY THE ORDER and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of the 14 July 2009 apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.
