TOWN AND COUNTRY PLANNING ACT 1990

THE SECRETARY OF STATE hereby gives notice that he has made an Order under Section 247 of the above Act entitled “The Stopping up of Highway (West Midlands) (No. 15) Order 2009” authorising the stopping up of a 27.9 metre northern part width of Pipers Green comprising highway verge, lying between the back of the northern footway of Pipers Green and the southern boundary of No 26 Kedleston Road, commencing 43 metres east of its junction with Kedleston Road at Hall Green in the City of Birmingham, to enable the development described in the Schedule to this notice to be carried out in accordance with the outline planning permission granted to Damson Homes by Birmingham City Council on 25 September 2008 under reference S/03355/08/OUT and the planning permission (granting approval of reserved matters of the aforementioned outline planning permission) granted to Damson Homes by Birmingham City Council on 11 March 2009 under reference S/00175/09/RES.

COPIES OF THE ORDER MAY BE OBTAINED, free of charge, on application to the Secretary of State, addressed to the National Transport Casework Team, Government Office for the North East, Citygate, Gallowgate, Newcastle upon Tyne NE1 4WH (quoting reference NATTRAN/WM/S247/53) and may be inspected at all reasonable hours at Shirley Library, Church Road, Shirley B90 2AX.

ANY PERSON AGGRIEVED BY THE ORDER and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of the 6 May 2009 apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.
