THE COUNCIL OF THE LONDON BOROUGH OF SOUTHWARK hereby gives notice that it has made an Order under section 247 of the above Act entitled The London Borough Southwark (Stopping Up and Provision of Highways) (No.1 : LONGHOPE CLOSE AND DANIEL GARDENS) ORDER 2009 authorising:

The stopping up of the area of highway known as Longhope Close, running in a north to south direction and lying to the east of Gloucester Infants school and a section of Longhope Close running parallel to Burcher Gale Grove and running into Daniel Gardens, London SE15 6BQ.

  • 1 An area of highway on the eastern side of Gloucester Infants School, between the playground at the rear of Cam Court and Daniel Gardens extending for an approximate length of 100 metres in a north south direction and with a width not exceeding 9 metres and approximately for a length of 35 metres in an east west direction and with a width not exceeding 8 metres.
  • 2 An area of footway running 16.50 metres in a westerly direction, from a point at the back edge of the footway on the western side of the access to the former Sharpness Court with a width not exceeding 2.33 metres.

The provision of highway comprising an area of footway and an area of carriageway, between Burcher Gale Grove and where Daniel Gardens runs into Longhope Close, London SE15 6BQ.

  • 1 An area of footway extending 17.5 metres south-westwards from a point at the north easternmost point of the carriageway of Burcher Gale Grove and with a width not exceeding five metres.
  • 2 An area of highway measured from a point approximately 40.5 metres east of the boundary fence of Gloucester Infants School and 2.5 metres north of the carriageway of Burcher Gale Grove, extending 8.5 metres in a westerly direction with a width not exceeding 5.5 metres.

The Order is to enable the development described in the Schedule to this notice to be carried out in accordance with the planning permission granted under Part III of the Act to Southwark Council by the Council of the London Borough of Southwark on the 4th March 2009 under LBS reference 08-CO-0113.

Copies of the Order may be obtained on application to the Council’s Environment and Leisure Department, at the Old Town Hall Reception Desk, 151 Walworth Road, London, SE17 1RY quoting reference LEG/PLA/132111(GB) and may be inspected at those offices during all reasonable hours.

Any person aggrieved by the Order and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any regulation made thereunder has not been complied with in relation to the Order may, within 6 weeks of 30th April 2009, apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.

The Schedule

Permission was granted for the change of use and redevelopment of land at Saul, Sharpness and Painswick Court to provide a new single storey secondary school for students with profound and complex learning difficulties, with associated access, parking, amenity space and the closure of a section of Longhope Close (running north/south parallel to Gloucester Primary School) and an approximate 30m length of Daniel Gardens (at its western most end adjoining Longhope Close).
