TOWN AND COUNTRY PLANNING ACT 1990

THE SECRETARY OF STATE hereby gives notice that he has made an Order under Section 247 of the above Act entitled “The Stopping up and Diversion of Highways (North East) (No.06) Order 2009” authorising the stopping up of a length of Byway 30 and the diversion of two lengths of Byway 30 at Spennymoor, in the Borough of Sedgefield to enable the development described in the Schedule to this notice to be carried out in accordance with planning permission granted to Barratt Newcastle by the Secretary of State for Communities and Local Government on 21 June 2007 under reference APP/M1330/A/06/2020822 and APP/M1330/A/06/2027813.

COPIES OF THE ORDER MAY BE OBTAINED, free of charge, on application to the Secretary of State, addressed to the National Transport Casework Team, Government Office for the North East, Citygate, Gallowgate, Newcastle upon Tyne NE1 4WH (quoting reference NATTRAN/NE/S247/38) and may be inspected at all reasonable hours c/o Pauline Wilson, Spennymoor Town Council, Spennymoor Town Hall, High Street, Spennymoor DL16 6DG.

ANY PERSON AGGRIEVED BY THE ORDER and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of the 31 March 2009 apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.

Planning permission is granted for the erection of 100 dwellings and associated infrastructure works including new access road, alterations to existing byway, public car park and sewer arrangements at land off Whitworth Road, Whitworth Park, Spennymoor, County Durham.
