TOWN AND COUNTRY PLANNING ACT 1990

THE SECRETARY OF STATE hereby gives notice that he has made an Order under Section 247 of the above Act entitled “The Stopping up of Highways (South East) (No. 8) Order 2009” authorising the stopping up of an irregular shaped eastern part width of Stanhope Square, an irregular part width of Luddenham Close which extends in a westerly direction from the main carriageway of Luddenham Close and lies to the south of the garages (to be demolished), an irregular shaped southern part width of the cul-de-sac arm which lies to the north of the Stanhope Square garages, the whole of the footpath which lies immediately to the west of No. 39 Luddenham Close and a length of the footpath which lies to the east of Ackerley Court at Stanhope, in the Borough of Ashford, to enable the development described in the Schedule to this notice to be carried out in accordance with planning permission granted to Ashford Borough Council under reference 05/01629/AS (outline application) and to Gleeson Homes Southern under reference 06/01875/AS (reserved matters) by Ashford Borough Council on 2 May 2006 and 6 December 2006 respectively.

COPIES OF THE ORDER MAY BE OBTAINED, free of charge, on application to the Secretary of State, addressed to the National Transport Casework Team, Government Office for the North East, Citygate, Gallowgate, Newcastle upon Tyne NE1 4WH (quoting reference NATTRAN/SE/S247/67) and may be inspected at all reasonable hours at Meet and Greet, Ashford Borough Council, Civic Centre, Tannery Lane, Ashford, Kent TN23 1PL.

ANY PERSON AGGRIEVED BY THE ORDER and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of the 19 March 2009 apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.

The Schedule

Outline planning permission (05/01629/AS) is granted for demolition and redevelopment of ten sites for new housing, shops, community facilities, library and public house at various sites including blocks of flats, Stanhope Estate, Stanhope Road, Stanhope, Ashford; and Planning permission (reserved matters) (06/01875/AS) is granted for demolition of two storey block of flats and the shops to the north of Stanhope Square and redevelopment of this site and two others to provide 93 residential houses and flats, no higher than three storeys. Associated external works in the form of parking, landscaping, roads and footpaths etc at sites 8, 9 and 10 Stanhope Estate Development, Stanhope Road, Stanhope, Ashford, Kent.
