THE BRENT (WAITING AND LOADING RESTRICTION) (AMENDMENT NO. 308) ORDER 2009

THE BRENT (PARKING PLACES) (NO. 10, 2004) (AMENDMENT NO. 1) ORDER 2009

  • 1 NOTICE IS HEREBY GIVEN that the Council of the London Borough of Brent on 9 March 2009 made the above-mentioned Orders under sections 6, 45, 46, 49 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984 as amended by section 8 of and Part 1 of Schedule 5 to the Local Government Act 1985, the Parking Acts of 1986 and 1989 and the Traffic Management Act 2004.
  • 2 The general effect of the ‘Waiting and Loading Restriction’ Order will be further to amend the Brent (Waiting and Loading Restriction) Order 1979, so that:—
    • a waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be prohibited at any time in the lengths of streets specified in the Schedule to this Notice;
    • b waiting by vehicles for the purpose of delivering or collecting goods or loading or unloading a vehicle for a period of more than 20 minutes in the same place will be prohibited between 11.00 a.m. and 6.30 p.m. throughout the week in the lengths of streets specified in the Schedule to this Notice;
    • c the sale or offer for sale of goods from a vehicle will be prohibited (except on Sundays in the lengths of streets specified in the Schedule) unless there is in force a valid licence issued by the Brent Borough Council or the goods are immediately taken into or delivered at premises adjacent to the vehicle from which the sale is effected;
    • d the use of any vehicle or of any animal or the wearing of fancy dress or other costume, wholly or mainly for the purpose of advertising will be prohibited.
  • 3 The prohibitions referred to in sub-paragraph 2(a) and 2(b) above will not apply in respect of anything done with the permission or at the direction of a police constable in uniform or in certain circumstances, e.g., the picking up or setting down of passengers; the carrying out of statutory powers or duties; the taking in of petrol, etc., from roadside petrol stations; to licensed street traders, etc. The usual exemption relating to vehicles displaying a disabled person’s “Blue Badge” will apply.
  • 4 The general effect of the ‘Parking Places Amendment’ Order will be to increase in length the existing dual use and resident parking places following the removal of the no longer required crossover outside Nos. 1 to 12 The Elms, Nicoll Road.
  • 5 A copy of each of the Orders, which will come into operation on 23 March 2009, of maps of the relevant areas, of the above-mentioned Order of 1979 (and of the Orders which have amended that Order) and 2004 can be inspected during normal office hours on Mondays to Fridays inclusive until the end of six weeks from the date on which the Orders were made at:—
    • a The One Stop Local Office, Brent Town Hall, Forty Lane, Wembley, Middx, HA9 9HX; and
    • b The One Stop Local Office, Brent House, 349-357 High Road, Wembley, Middx, HA9 6BZ.
  • 6 Copies of the Orders may be purchased from the address mentioned in paragraph 5(b) above.
  • 7 Any person desiring to question the validity of either of the Orders or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984 or that any of the relevant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to either of the Orders may, within six weeks of the date on which the Orders were made, make application for the purpose to the High Court.

Waiting restrictions (At any time)

Alder Grove, the south-west side, from a point 10.00 metres north-west of Paddock Road to a point 3.70 metres north-west of Nos. 13 and 15 Alder Grove.

Apsley Way, the south-west side, from the south-eastern boundary of No. 5 The Harp Business Centre, Apsley Way south-eastward for 25.00 metres.

Brook Road, the north-east side, from a point 10.00 metres north-west of Paddock Road to a point 10.00 metres south-east of Paddock Road.

Dollis Hill Lane, the south-east side, from 25.00 metres north-east of Dudden Hill Lane to a point 2.20 metres north-east of Nos. 3 and 5 Dollis Hill Lane.

Paddock Road

  • a from Alder Grove south-west for a distance of 10.00 metres.
  • b from Brook Road to a point 5.60 metres south-west of Nos. 1 and 3 Paddock Road.
