TOWN AND COUNTRY PLANNING ACT 1990

THE SECRETARY OF STATE hereby gives notice that he has made an Order under Section 247 of the above Act entitled “The Stopping up of Highways (Yorkshire & The Humber) (No. 08) Order 2009” authorising the stopping up of a hammerhead shaped area of highway at the southern end of Back Lane, the whole of the western part width of the highway verge of Footpath No. 254 Halifax, the whole of the unnamed footpath extending northwards from its junction with Furness Avenue to its junction with Turner Avenue North, and the whole of the unnamed footpath extending eastwards from its junction with the eastern side of Turner Avenue North commencing 22 metres north east of the junction of Turner Avenue North and Furness Avenue at Illingworth in the Metropolitan Borough of Calderdale to enable the development described in the Schedule to this notice to be carried out in accordance with planning permission granted to Wm Morrison Supermarkets PLC by Calderdale Metropolitan Borough Council on 28 November 2008 under reference 08/00672/FUL.

COPIES OF THE ORDER MAY BE OBTAINED, free of charge, on application to the Secretary of State, addressed to the National Transport Casework Team, Government Office for the North East, Citygate, Gallowgate, Newcastle upon Tyne NE1 4WH (quoting reference NATTRAN/Y&H/S247/74) and may be inspected at all reasonable hours at Illingworth Moor Post Office, Illingworth Road, Halifax HX2 9EN.

ANY PERSON AGGRIEVED BY THE ORDER and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of the 6 March 2009 apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.
