TOWN AND COUNTRY PLANNING ACT 1990

THE SECRETARY OF STATE hereby gives notice that he has made an Order under Section 247 of the above Act entitled “The Stopping up of Highways (North East) (No. 05) Order 2009” authorising the stopping up of a length of Swanway commencing from its southern termination point extending south westwards for a maximum distance of 17 metres and the network of footpaths bounded to the north by the aforementioned cul-de-sac termination point and to the south by the unnamed Footpath to the south of No. 36 Causeways at Sheriff Hill, Gateshead, in the Borough of Gateshead to enable the development described in the Schedule to this notice to be carried out in accordance with planning permission granted to The Gateshead Housing Company by Gateshead Metropolitan Borough Council on 22 September 2008 under reference DC/08/00968/FUL.

COPIES OF THE ORDER MAY BE OBTAINED, free of charge, on application to the Secretary of State, addressed to the National Transport Casework Team, Government Office for the North East, Citygate, Gallowgate, Newcastle upon Tyne NE1 4WH (quoting reference NATTRAN/NE/S247/43) and may be inspected at all reasonable hours at c/o Carole Nicholson (Tenant Liaison Manageress), Gateshead Housing Company, Gateshead Council, Civic Centre, Regent Street, Gateshead, Tyne and Wear NE8 1HH.

ANY PERSON AGGRIEVED BY THE ORDER and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of the 5 March 2009 apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.

Planning permission is granted for landscaping works including planting of mature trees to create mini parkland and paved footpath and erection of wall/railings at north and south entrances to area including 2 bollards at north entrance at Swanway, Carr Hill, Gateshead, Tyne and Wear NE9 5QS.
