PLANNING (LISTED BUILDINGS AND CONSERVATION AREAS) ACT 1990 (“THE 1990 ACT”), SECTION 69

BEAULIEU CONSERVATION AREA

NOTICE IS HEREBY GIVEN under the provisions of the 1990 Act that New Forest National Park Authority (“the Authority”) has determined that the area described in the Schedule to this Notice is an area of special architectural or historic interest, and that it is desirable to preserve or enhance its character or appearance. Accordingly, on 29 January 2009, it amended the scope of Beaulieu Conservation Area.

The principal effects of the designation of this area as a conservation area are as follows:

  • 1 The Authority is under a duty to prepare proposals to ensure the preservation or enhancement of the area.
  • 2 The consent of the Authority must be obtained prior to the demolition of any building in the area.
  • 3 Additional publicity must be given to planning applications for development in the area.
  • 4 In carrying out any functions under the planning acts (and, in particular, in determining applications for planning permission and listed building consent), the Authority and the Secretary of State are required to take into account the desirability of preserving or enhancing the character or appearance of the area.
  • 5 Six weeks notice must be given to the Authority before works are carried out to any tree situated within the area.

Schdule

The boundaries are:

In a clockwise direction from the north side of Hatchet Lane at a point to the east entrance splay to Harlicks Cottage, east along the northern boundary of Hatchet Lane to a point on the southeast corner of the land of the Police House, then north, then east along the northern hedge-line of Hatchet Lane to include the wide verge opposite the junction with the High Street. North along the western hedge-line of the B3056 to a point on the southern boundary of Shepherds Mead, then west, north and east around the boundaries of the land and including land including Shepherds Mead. North along the western hedge-line of the B3056, cross the road going to a point on the northwest corner of the Mill Dam, then north along the boundary of the copse to a point where it joins the Beaulieu River. Cross the river northwards, then east, north and east following the northern river bank to a point where the drain joins the river. Then northeast along the drain to a point where it joins the path, then south to the corner of the medieval Abbey Precinct wall. Northeast along the line of the former Precinct wall to a point on the east side of the tarmac path circumnavigating the Motor Museum, then southeast and east following the path to a point on the southeast corner of the tarmac exhibition area. North, west and northwest along the eastern boundary of the tarmac exhibition area to a point where it crosses the line of the former Precinct wall, then northeast and east along the southern boundary of the path to a point where it joins the main drive. North, then east crossing the main drive to join the earthen bank adjoining the Fulling Mill land. Southeast, then south along the eastern edge of the boundary bank to a point where it joins the boundary bank on the north side of the Abbey grounds. Northeast along the northern edge of this bank to a point where it joins the line of the medieval Precinct wall. East to include the standing remains and land of the Precinct wall to a point where it joins the eastern boundary hedge of the Abbey land. Then south along the hedge-line and to include the hedge-line to a point to the south of the pond, east along the northern boundary and to include the land of the cricket field, then southeast and south along the eastern boundary of the cricket field to a point at the southern corner of the land of Monkswell House where it adjoins Palace Lane. Northeast along the eastern boundary of Palace Lane, then cross Palace Lane to a point on the north corner of the lands of Home Farm and the Out of Town Centre. Southeast and southwest along the eastern boundary to include the land and including land including Home Farm and the Out of Town Centre to a point where it joins the track to Home Farm Cottages. North along the western boundary of the track to include the land and including land including: Kelham; the farm buildings and 1 and 2 Home Farm Cottages. Then southwest, northwest, east and north along the southern boundary of the land of Home Farm, then west along the southern boundary to include the land and including land including Home Farm farmhouse and Hayters Mead to a point where it joins Dock Lane. South along the eastern boundary of Dock Lane to a point at the northwest corner of the land of Dock Cottage. Northeast, southeast and southwest along the boundary to include the land and including land including Dock Cottage and Carpenters Cottage to a point at the south of the land where it adjoins Dock Lane. Southeast, east and south along the extent of the northern then eastern boundary of Dock Lane to its southern extremity. Then northeast, east and southeast around and to include the land and including land including: The Cottage, Flat 1 Spearbed Copse and Spearbed Copse (House) to a point where it joins the Beaulieu River. Then east and south across the mudflats and river to the south to a point on the northwest corner of Keeping Marsh Nature Reserve on the southern bank of the Beaulieu River. South along the western boundary of Keeping Marsh to a point where it joins the Solent Way long distance footpath, then northwest along the southern boundary of the Solent Way footpath to the point where it joins Bailey’s Hard Lane. Northwest along the southern edge of the lane to Frank’s Yard, southeast, southwest, northwest and northeast around the boundary of the land and including land including Frank’s Yard. Then northeast along the southern boundary of the Solent Way to a point at the northeast corner of Jervis’s Copse, then north to the junction of the Solent Way and the secondary footpath leading to The Lodge. West then northwest along the southern boundary of this secondary footpath to the northeast corner of the lands of The Lodge. Southwest, northwest, southwest and northwest along the boundary of the lands and including land including: The Lodge and The Lodge Cottage. Then southwest, southeast and southwest along the southern boundary of the land and including land including: Chestnut Cottage and Holt Cottage to a point where it joins the Buckler’s Hard Road. Cross the road, then west to include the lands and including land including Rose Cottage and Myrtle Cottage to a point at which it joins Hatchet Lane. Cross the road to the north side of Hatchet Lane to a point to the east entrance splay to Harlicks Cottage.
