PLANNING (LISTED BUILDINGS AND CONSERVATION AREAS) ACT 1990 (“THE 1990 ACT”), SECTION 69

BANK CONSERVATION AREA

NOTICE IS HEREBY GIVEN UNDER THE PROVISIONS OF THE 1990 ACT THAT NEW FOREST NATIONAL PARK AUTHORITY (“THE AUTHORITY”) HAS DETERMINED THAT THE AREA DESCRIBED IN THE SCHEDULE TO THIS NOTICE IS AN AREA OF SPECIAL ARCHITECTURAL OR HISTORIC INTEREST, AND THAT IT IS DESIRABLE TO PRESERVE OR ENHANCE ITS CHARACTER OR APPEARANCE. ACCORDINGLY, ON 16 OCTOBER 2008, IT EXTENDED THE BOUNDARIES OF BANK CONSERVATION AREA.

The principal effects of the designation of this area as a conservation area are as follows:

  • 1 The Authority is under a duty to prepare proposals to ensure the preservation or enhancement of the area.
  • 2 The consent of the Authority must be obtained prior to the demolition of any building in the area.
  • 3 Additional publicity must be given to planning applications for development in the area.
  • 4 In carrying out any functions under the planning acts (and, in particular, in determining applications for planning permission and listed building consent), the Authority and the Secretary of State are required to take into account the desirability of preserving or enhancing the character or appearance of the area.
  • 5 Six weeks notice must be given to the Authority before works are carried out to any tree situated within the area.

Schedule

The boundaries are:

In a clockwise direction, from the A35, east along the track to the cattle grid then south east and south west around the land of and including Cuffnell Cottage, Oak Tree House and Lane End. Continuing south west to the junction with the field boundary, then south east along the field boundary to the junction with the next field boundary, then south west along that boundary to the land of and including Westons. Then south east along the boundary between the small and large fields, including therefore the small fields to the west, and up to the land of and including Deerhurst Cottage. North east along the north verge of Pinkney Lane up to a point opposite the land of Dairy Cottage, there crossing Pinkney Lane to the south verge and south west to the point at which Pinkney Lane turns north west. There following the field boundary south east up to the semi circular land line and following this north west and north east to return to the south verge to the south side of Pinkney Lane. Following this verge to the next curved land line to the south, there following this line back to Pinkney Lane and the east side of the lane up to the boundary of the land of and including Forest Green House. Following south west and north west the boundary of Forest Green House, south west the next field boundary and then the land of and including Dell Cottage, and west to follow the south side of the track that leads to Dell House up to the west side of the road to Gritnam. North and north east along the west side of the road up to and including the land of the Bee Garden. Then following the wide verge to the west of the road north to where it rejoins the road. Continuing north along the west side of the road to follow where the verge again diverges, crossing the track, and up to the land of and including Vine Cottage. Then continuing along the west side of the verge north and around the curved land line up to the cattle grid. East across the road, around the entrance to Oak Tree House and to the west side of the verge up to land of Cuffnell Cottage. North across the track from the A35.
