THE SECRETARY OF STATE hereby gives notice that she has made an Order under Section 247 of the above Act entitled “The Stopping up of Highway (North West) (No. 15) Order 2008” authorising the stopping up of a part of Elton Head Road, St Helens to enable the development described in the Schedule to this notice to be carried out in accordance with planning permission granted to Sherdley Estates on 21st November 2005 under reference P/2004/0429 and the reserved matters given to Wainhomes (NW) Ltd on 4th August 2006 under reference P/2006/0584, both granted by St Helens Metropolitan Borough Council.

COPIES OF THE ORDER MAY BE OBTAINED, free of charge, on application to the Secretary of State, addressed to the National Transport Casework Team, Government Office for the North East, Citygate, Gallowgate, Newcastle upon Tyne NE1 4WH (quoting reference NATTRAN/NW/S247/35) and may be inspected at all reasonable hours at offices of St Helens MBC, Town Hall, Victoria Square, St Helens.

ANY PERSON AGGRIEVED BY THE ORDER and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of the 9 October 2008 apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.

The stopping up is to enable: P/2004/0429 Outline application for mixed use development comprising B1 (Business), B2 (General Industrial) and C3 (Residential) together with an extension to existing park and ride facility at Lea Green Railway Station and with ancillary A4 (Pubs and bars) element. (Previously proposed retail element deleted).

P/2006/0584 Reserved matters application for erection of 90 dwellings pursuant to outline application P/2004/0429.
