TOWN AND COUNTRY PLANNING ACT 1990

THE SECRETARY OF STATE hereby gives notice that she proposes to make an Order under section 247 of the above Act to authorise the stopping up of two part widths of Cross Street, consisting of footway abutting the western boundary of the Sol Viva Nightclub and an area of Clerke Street at the corner of Clerke Street and Rochdale Road, at Bury in the Metropolitan Borough of Bury.

IF THE ORDER IS MADE, the stopping up will be authorised only in order to enable the development described in the Schedule to this notice to be carried out in accordance with the planning permission granted to Thornfield Properties by Bury Metropolitan Borough Council on 25 January 2006 under reference No. 45426.

COPIES OF THE DRAFT ORDER AND RELEVANT PLAN MAY BE INSPECTED at all reasonable hours during 28 days commencing on 2 October 2008 at Bury Metropolitan Borough Council, Town Hall, Knowsley Street, Bury, BL9 0SW and may be obtained free of charge from the Secretary of State at the offices of the Department for Transport (quoting reference NATTRAN/NW/S247/44) at the address stated below.

ANY PERSON MAY OBJECT to the making of the proposed order within the period of 28 days commencing on 2 October 2008 by notice to the Secretary of State, quoting the above reference, addressed to the National Transport Casework Team, Government Office for the North East, Citygate, Gallowgate, Newcastle upon Tyne NE1 4WH.

In preparing an objection it should be borne in mind that the substance of it may be imparted to other persons who may be affected by it and that those persons may wish to communicate with the objector about it.

Planning permission is granted for mixed use development comprising shopping; financial and professional services; food and drink uses within the A1, A2, A3, A4 and A5 use classes; assembly and leisure facilities within the D1 and D2 use classes: nightclub use; business uses within the B1 use class; and other associated works and facilities, at Hornby Buildings, The Rock, Bury.
