THE GREENWICH (WAITING AND LOADING RESTRICTION) (AMENDMENT NO. 9) ORDER 2008

• 1 NOTICE IS HEREBY GIVEN that Greenwich Council, hereinafter called the Council, with the consent of the London Borough of Lewisham, on 30 July 2008 made above-mentioned Orders under sections 6, 35, 45, 46, 49 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984, as amended.
• 2 The general effect of the above-mentioned Orders would be to amend each of the Orders listed in the Schedule to this Notice so that they comply with those civil enforcement provisions, relating to parking and waiting, in part 6 of the Traffic Management Act 2004, which came into force on 31st March 2008 and comply with the requirements of Civil Enforcement of Parking Contraventions (England) General Regulations 2007:—
  • a In effect this means that all references to the Road Traffic Act 1991 in the Orders will be substituted with the Traffic Management Act 2004 and where appropriate the Civil Enforcement of Parking Contraventions (England) General Regulations 2007, any references to Decriminalised Parking Enforcement will now refer to Civil Parking Enforcement, any references to a Parking Attendant will now refer to a Civil Enforcement Officer (CEO) and any references to a Special Parking Area will now refer to a Civil Enforcement Area (CEA).
  • b All references to a penalty charge or penalty charge notice will be substituted with references to such charges being imposed in accordance with Part 6 of the Traffic Management Act 2004 and the Civil Enforcement of Parking Contraventions (England) General Regulations 2007. Under the differential parking penalties system different levels of charges are payable for Penalty Charge Notices as some contraventions are considered more serious than others, and carry a greater penalty. • 3 The further effect of the Waiting and Loading Amendment Order will be to amend the Greenwich (Waiting and Loading Restriction) Order 2007 so that in addition to the amendments mentioned in paragraphs 2(a) and 2(b) above, an amendment will be made to the Order where any reference to ‘the period for which a vehicle may wait in a restricted street for the purpose of loading and unloading’, the words “twenty minutes” will be substituted with the words “forty minutes”.
• 4 Copies of the Orders, which will come into force on 1 August 2008, of the Order being amended and of other documents giving more detailed particulars of the Orders, are available for inspection during normal office hours on Mondays to Fridays inclusive, at Greenwich Transportation and Highways, Strategic Planning Department, Greenwich Council, Peggy Middleton House, 50 Woolwich New Road, Woolwich SE18 6HQ for six weeks following the date the Orders were made and copies of the Orders may be obtained from the same address.
• 5 Any person desiring to question the validity of the Orders or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984 or that any relevant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to the Orders may, within six weeks of the making of the Orders, make application for the purpose to the High Court.
