THE COUNCIL OF THE LONDON BOROUGH OF SUTTON, having consulted with the Commissioner of the Metropolitan Police, in exercise of the powers conferred by sections 9, 10 and 124 of, and Parts III and IV of Schedule 9 to, the Road Traffic Regulation Act 1984 (a), as amended by section 8(1) of, and Schedule 5 to, the Local Government Act 1985 (b) and Part II of the Road Traffic Act 1991 (c) and all other powers so enabling hereby make the following Order:

  • 1 This Order may be cited as The Sutton (Sutton Town Centre Renewal) (No. 1) Experimental Order 2008 and shall come into operation on 11 August 2008.
  • 2 -(1) In this Order, unless the context otherwise requires, the following expressions have the meanings hereby assigned to them:

“goods vehicle” has the same meaning as in the Traffic Signs Regulations and General Directions 2002 (d) ;

“enactment” means any enactment whether public, general or local and includes any order, bye-law, rule, regulation, scheme or other instrument having effect by virtue of an enactment;

“pedal cycle” has the same meaning as in the Traffic Signs Regulations and General Directions 2002 (d) .

(2) Any reference in this Order to any enactment shall be construed as a reference to that enactment as amended, applied, consolidated, re-enacted by or as having effect by virtue of any subsequent enactment.

(3) The Interpretation Act 1978 (e) shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

  • 3 Whilst this Order continues in force:-
    • a the provisions of The Sutton (Waiting and Loading Restriction) (No. 19) (Consolidation No. 10) Order 2007 (f), as amended, shall apply to the lengths of street and during the prescribed hours specified in the items set out in columns 1, 2 and 3 of Schedule 1 to this Order;
    • b the provisions of The Sutton (Waiting and Loading Restriction) (No. 19) (Consolidation No. 10) Order 2007 (a1), as amended, shall apply to the lengths of street and during the restricted hours specified in the items set out in columns 1, 2 and 3 of Schedule 2 to this Order;
    • c the provisions of The Sutton (Waiting and Loading Restriction) (No. 19) (Consolidation No. 10) Order 2007 (a1), as amended, are amended by the addition of the prescribed / restricted hours set out in columns 1, 2 and 3 of Schedule 3 to this Order;
    • d the provisions of The Sutton (Disabled Persons Parking Places) (No. 5) (Consolidation No. 5) Order 2006( b1), as amended, shall apply to the length of street and during the prescribed hours specified in the item set out in columns 1, 2 and 3 of Schedule 4 to this Order;
    • e the provisions of The Sutton (Traffic Restriction) (Prohibition of Motor Vehicles) (No. 2) Order 2005 (c1) are amended by the addition of the following sub-article to Article 4 of that Order:-

‘(e) pedal cycles’;

  • f no person shall cause any vehicle to enter those lengths of streets set out in columns 1 and 2 of Schedule 5 to this Order at any time.
  • g the provisions of the Orders set out in columns 1, 2 and 3 of Schedule 6 to this Order are suspended; and
  • h the provisions of those parts of the Orders set out in columns 1, 2, 3 and 4 of Schedule 7 to this Order are suspended.
  • 4 Nothing in Article 3(f) of this Order shall apply in relation to:-
    • a a pedal cycle;
    • b a goods vehicle between the hours of 8.00 p.m. and 10.00 a.m. throughout the week for the purposes of loading or unloading goods;
    • c any vehicle being used for ambulance, fire brigade or police purposes in an emergency;
    • d a Post Office vehicle engaged upon the delivery and collection of letters and postal packets as defined in section 125 of the Postal Services Act 2000 (d1) ;
    • e anything done with the permission or at the direction of a police constable in uniform;
    • f any person who causes a vehicle to proceed in accordance with any restriction or requirement indicated by traffic signs places pursuant to section 66 or section 67 of the Road Traffic Regulation Act 1984 (e1) ;
    • g any vehicle being used by a statutory undertaker in an emergency; and
    • h any vehicle in accordance with a special authorisation given by the Council.

5. In pursuance of section 10(2) of the Road Traffic Regulation Act 1984 the Executive Head of Planning, Transport and Highways of the London Borough of Sutton, or other person authorised in that behalf by that officer may, if it appears to that officer or to that person essential in the interests of the expeditious, convenient and safe movement of traffic, or of the provision of suitable and adequate parking facilities on the highway, or for preserving or improving the amenities of the area through which the road affected by this Order runs, modify or suspend this Order or any provision thereof.

EXPLANATORY NOTE
(This note is not part of the Order)

This Order, on an experimental basis:-

  • a introduces waiting restrictions “no waiting at any time” in High Street and Throwley Road, Sutton (see Schedule 1 items 1 and 2);
  • b introduces loading / unloading restrictions “no loading / unloading between 10.00 a.m. and 8.00 p.m. throughout the week” in High Street, Sutton (see Schedule 2);
  • c introduces the prescribed / restricted hours “between 10.00 a.m. and 8.00 p.m. throughout the week” (see Schedule 3);
  • d introduces a disabled persons parking place operating at any time on the south-east side of Throwley Road, Sutton (see Schedule 4);
  • e introduces a traffic restriction “no vehicles at any time” in lengths of the following streets:-
    • i High Street, Sutton (see Schedule 5, item 1);
    • ii St Nicholas Road, Sutton (see Schedule 5, item 2); and
    • iii Throwley Road, Sutton (see Schedule 5, item 3);

  • h suspends the traffic restrictions “no vehicles between 9.00 p.m. and 4.00 a. m. throughout the week except for access” in High Street and St Nicholas Road, Sutton (see Schedule 7, Order 1993/10);
  • i suspends the one-way restrictions in High Street and Throwley Road, Sutton (see Schedule 7, Order 1999/19);
  • j suspends the loading bay where “loading / unloading is limited to 30 minutes with no return within 2 hours operating at any time” in High Street, Sutton (see Schedule 7, Order 2000/4);
  • k suspends the disabled persons parking place operating “between midnight and 10.00 a.m. and between 6.00 p.m. and midnight throughout the week” in High Street, Sutton (see Schedule 7, Order 2006/33);
  • l suspends the motorcycle parking place operating “between 8.00 a.m. and 6.30 p.m. on Mondays to Saturdays inclusive” in Throwley Road, Sutton (see Schedule 7, Order 2006/26);
  • m suspends a number of waiting and loading restrictions in High Street Sutton (see Schedule 7, order 2007/54); and
  • n amends the traffic restriction “no vehicles at any time” in High Street, Sutton to allow pedal cycles (see Article 3(d)).

STATEMENT OF REASONS

“The Council is committed to enhancing the pedestrian and cycling environment in Sutton High Street to preserve and improve amenities for all users. The Experimental Traffic Order will enable the Council to observe the effects of the Order on different user groups and to discuss those observations before formulating permanent proposals.”
