PROPOSAL TO DESIGNATE AREAS WITHIN THE CITY OF WESTMINSTER SO AS TO REGULATE THE DISPLAY OF PORTABLE ADVERTISMENTS

SECTION 6 OF THE LONDON LOCAL AUTHORITIES ACT 2007

Notice is hereby given pursuant to section 6(3) of The London Local Authorities Act 2007 (hereinafter referred to as “the Act”) that Westminster City Council proposes to designate the areas shown in the attached Schedule under section 6(1) of the Act.

If the areas are designated it will be an offence to display a portable advertisement or to cause or permit any person to display a portable advertisement in any of the areas identified in the Schedule to this Notice unless the advertisement is given express consent or it has the benefit of deemed consent in accordance with the Town and Country Planning (Control of Advertisements) (England) Regulations 2007.

The council can only exercise its powers under section 6 of the Act in the interests of amenity and public safety, taking account of any material factors, and in particular the factors set out in section 6(2) of the Act.

A portable advertisement means any thing which is capable of being held or carried and which is an advertisement as defined (but with amended wording) in section 336(1) of the Town and Country Planning Act 1990 as follows:

“advertisement” means any word, letter, model, sign, placard, board, notice, device or representation, whether illuminated or not, in the nature of, and employed wholly or mainly for the purposes of, advertisement, announcement or direction, and (without prejudice to the previous provisions of this definition) includes any hoarding or similar structure used, or adapted for use, for the display of advertisements, and references to the display of advertisements shall be construed accordingly.

The “display” of an advertisement means the display of the advertisement in the course of a business by means of an individual or individuals holding or carrying it or otherwise having control of it in person at the place where it is located. Without prejudice to the generality of the offence, a person shall be deemed to display a portable advertisement if the advertisement gives publicity to his goods, trade, business or other concerns.

A portable advertisement shall be deemed to be displayed as a portable advertisement notwithstanding that it is placed upon, leant against or attached to apparatus, street furniture or any other structure or object situated (a) in a designated area; or (b) on any land within 7 metres of any street or way designated under section 6(1) of the Act.

A copy of the maps defining the areas that are proposed for designation will be kept at the offices of the Council at Council House, Marylebone Road, London NW1 5PT and also at One Stop Services, 64 Victoria Street, SW1E 6QP; 313 Harrow Road, W9 and 91-93 Church Street, NW8 and will be open to public inspection without payment on any week day, during the usual office hours, for 21 days from the date of the publication of this Notice. Copies will also be kept at Council Libraries.

Any objection to the proposals should be made in writing to the Director of Planning and City Development (FAO David Parker), City Planning Group, 11th Floor, Westminster City Hall, 64 Victoria Street, London SW1E 6QP by no later than 4 April 2008.
