The Secretary of State for Transport hereby gives Notice that he has made an Order under Section 247 of the above Act entitled “The Stopping Up of Highways (counties of Derbyshire and Staffordshire) (No.15) Order 2006” authorising the stopping up of lengths of highway at Main Street and Footpath 30, Walton-on-Trent, Derbyshire/Staffordshire measuring a maximum length in total of 363 metres. The stopping up is authorised only in order to enable the development described in the Schedule to this Notice to be carried out in accordance with the planning permission granted to Roger Bullivant Ltd by the South Derbyshire District Council on 27th May 2005 under reference 9/2003/1525/M and on appeal by the Secretary of State for Communities and Local Government on 06 November 2006 under reference APP/B3410/A/05/1187474. The Order requires the provision of new highway by Roger Bullivant Ltd, maintainable at public expense, and for which the highway authorities are to be Derbyshire County Council and Staffordshire County Council. Copies of the Order may be obtained, free of charge, by applying to the Government Office for the East Midlands, Transport Policy, The Belgrave Centre, Stanley Place, Talbot Street, Nottingham NG1 5GG (quoting reference No EMCM 505035/1/297) and may be inspected at all reasonable hours at the offices of the South Derbyshire District Council, Planning Services, Civic Offices, Civic Way, Swadlincote, Derbyshire DE11 0AH and East Staffordshire Borough Council, Town Hall, Burton Upon Trent, Staffordshire DE14 2EB. Any person aggrieved by the Order and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of 11 December 2006 apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.
