Notice is hereby given in accordance with paragraph 8.2(b) of Part V of the Administrators’ proposals for Company Voluntary Arrangements (“CVAs”) in respect of the Companies dated 23 June 2006 (capitalised terms used in which shall have the same meaning in this notice) that the Effective Date of the CVAs has been reached and the date 11 October 2006 shall be the Effective Date.

Asbestos claims
The CVAs provide among other things for the establishment of the UK Asbestos Trust to compensate people who suffer from Asbestos Disease caused by the activities of the Companies (“ asbestos claimants”). The UK Asbestos Trust has been established and is now operating for those Companies. To apply for compensation from the UK Asbestos Trust, an asbestos claimant must complete the Proof of Claim form or instruct a lawyer to do so on their behalf.

Non-asbestos claims
Any holders of CVA claims (excluding personal injury claims resulting from exposure to asbestos) who wish to claim a dividend payment under the CVAs must submit a Notice of Claim Form by 27 December 2006. However, if a Notice of Claim Form has already been received from you, whether in relation to voting on the proposals or otherwise, there is no need for you to submit a further copy. With certain very limited exceptions, all CVA Claims (excluding personal injury claims resulting from exposure to asbestos) received after 27 December 2006 shall not have the right to any distribution under the relevant CVA and shall be released and discharged. This is without prejudice to the right of holders of APD Claims against a Company to assert such Claims in the Chapter 11 Case of that Company.
