PLANNING (LISTED BUILDINGS AND CONSERVATION AREAS) ACT 1990 SECTION 69
NOTICE OF DESIGNATION OF BOUGHTON CONSERVATION AREA NO 19

Notice is hereby given that pursuant to section 69 of the Planning (Listed Buildings and Conservation Areas) Act 1990, Worcester City Council resolved on 20 July 2006 to designate from that date the area described in the Schedule to this notice as a conservation area within the city of Worcester, in view of its special architectural or historic interest, the character or appearance of which it is considered desirable to preserve or enhance. The area will be known as the Boughton Conservation Area No 19.
The principal effects of this area being designated as a conservation area are as follows:

(a) The Council is under a duty to prepare proposals to ensure the preservation or enhancement of the area.
(b) It is an offence to cut down, lop, top, uproot, or wilfully damage or wilfully destroy any trees in a conservation area without prior notice being given to the council (subject to certain exemptions). Prior notice of intention to commence any of the above-mentioned acts must be served on the Council, giving 6 weeks notice.
(c) It is an offence to demolish any building (with certain limited exceptions), which is within a conservation area without the consent of the Local Planning Authority.
(d) It is an offence to demolish any gate, wall, fence or other means of enclosure (with certain limited exceptions) of a metre or more in height where abutting on a highway (including a public footpath or bridleway), waterway or open space, or two metres or more high in any other case which is within a conservation area without the consent of the Council as a Local Planning Authority.
(e) In carrying out any functions under the planning Acts and, in particular, in determining applications for planning permission and listed building consent, the Council and the Secretary of State are required to take into account the desirability of preserving or enhancing the character or appearance of the area.
(f) Special publicity will be given to planning applications, which are likely to affect the character or appearance of the conservation area.

Schedule
The area so designated is contained by the following boundaries:

To the north, the boundary follows the edge of Bransford Road from the roundabout on Grove Way and then north to meet the railway line. It then turns east to follow the railway line to where it crosses Bromyard Road.
The boundary then goes east along Bromyard Road to turn south to include the properties along the east side of Watery Lane.
To the east, the boundary runs south around the back of the properties fronting Watery Lane until it crosses Blakefield Road and joins Bransford Road. It then runs east along Bransford Road to School Road where it runs south along School Road and Skinner Road to Pitmaston Walk. Here the boundary turns west to include the allotment gardens and runs along Pitmaston Walk to where it joins Nursery Walk. From here it excludes the former Richard Smith Nursery site as it goes north to join Bransford Road. The boundary then turns west to include the Portobello Inn and follows Bransford Road to the corner of the Worcester Golf and Country Club Boughton Park. The remainder of the eastern boundary runs south along the edge of the Worcester Golf and Country Club.
To the south, the boundary runs along the edge of the golf club to meet Grove Way.
To the west, the boundary follows the edge of Grove Way to join up with the northern boundary at the roundabout to Bromyard Road.

Copies of this notice together with a plan showing the entire designated area is available for inspection at the Customer Services Centre, Orchard House, Farrier Street, Worcester WR1 3BB, on Monday, Tuesday, Thursday and Friday between 8.30 am and 5.00 pm, Wednesdays between 10.00 am and 5.00 pm and Saturdays between 9.00 am and 12.00 noon.
