TOWN AND COUNTRY PLANNING ACT 1990

The Secretary of State hereby gives notice that he has made an Order under section 247 of the above Act entitled “The Stopping-up of Highways (County of Durham) (No 9) Order 2006”, authorising the stopping-up of 4 cul-de-sac roads, 1 Heathfield Gardens, as leads off Langdon Gardens, and 3 unnamed as lead southwards off Rogerley Terrace, together with the network of footpaths, all of which lie to the south of Rogerley Terrace and to the north of Prince’s Street; of 3 footpaths, 2 of which connect Prince’s Street and the footpath which lies to the rear of York Street and one of which connects that latter footpath with the footpath which lies to the rear of Nos 1 to 11 Regent Street; and a length of that latter footpath as extends from Prince’s Street to the northern boundary of No 1 Regent Street, all at Catchgate, Stanley, County Durham, to enable the development described in the Schedule to this notice to be carried out in accordance with outline planning permission granted to and by Derwentside District Council, on 7 September 2004, under Ref 1/2004/0717/DCOP, and the reserved matters planning permission granted by Derwentside District Council, to Brosley Homes Limited, on 22 February 2006, under application Ref SW/1/2005/1032/DMFP. Copies of the Order may be obtained, free of charge, on application to the Secretary of State at the offices of the Director, Environment Group, Government Office for the North East, Citygate, Gallowgate, Newcastle upon Tyne NE1 4WH, (quoting Ref GO-NE/06/5053/35/06) and may be inspected at all reasonable hours at Catchgate Sub Post Office, Hobsons Buildings, North Road, Stanley. Any person aggrieved by the Order and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of 20 July 2006, apply to the High Court for the suspension or quashing of the Order or of any provision contained therein. M Grieveson, on behalf of the Department for Transport Schedule Outline planning permission has been granted for Residential Development, on former King Street, Prince’s Street and Heathfield Gardens, and reserved matters planning permission granted for the detail of that development as for the erection of 148 dwellings with associated works, at land to the south of Rogerley Terrace, Catchgate, Stanley, County Durham.
