NOTICE OF PROPOSED STOPPING-UP OF PART OF BYWAY 32 HAVERHILL WITH RESERVATION OF FOOTPATH AND BRIDLEWAY

Notice is hereby given that an application will be made to the Justices sitting at the Bury St Edmunds Magistrates’ Court, Suffolk, on 26 May 2006, at 11.00 am, for an Order that parts of the width of a length of byway open to all traffic known as No 32 Haverhill be stopped up and that the remaining byway width be stopped up with the reservation of footpaths or a bridleway. This length of byway runs from the junction with Bridleway 44 in a south-easterly and then south-westerly direction, passing through a gully then through a housing estate to the A1307 Withersfield Road. The application will be made on the grounds that:

this length of byway is necessary only for footpath use, except for a 26 metre length along the western side of Cangle Primary School (currently used as part of a cycle route) which is necessary only for bridleway use; and
on the lengths of reserved footpath and bridleway, it is no longer necessary for the public to have any rights over a width of more than 5 metres over the part of the route running south-westerly through the housing estate to Withersfield Road (and a width of 2 metres on five short spurs).

The route of the byway and those parts proposed to be stopped up and retained as footpath or bridleway are described in the Schedule to this notice.
A plan showing the extent of the byway proposed to be stopped up and retained as footpath or bridleway may be inspected, free of charge, at the offices of Suffolk County Council, Endeavour House, 8 Russell Road, Ipswich, 9.00 am to 6.00 pm Monday to Friday; also at Haverhill Library, Camps Road, 9.00 am to 1.00 pm Monday; 9.00 am to 7.00 pm Tuesday; 9.00 am to 1.00 pm and 4.00 pm to 6.00 pm Wednesday; 9.00 am to 7.00 pm Thursday; 9.00 am to 5.00 pm Friday; 9.00 am to 4.30 pm Saturday; and 10.00 am to 4.00 pm Sunday.

1. Commencing at the junction with Byway 32 and Bridleway 44 at a point at OS Grid Ref TL 66901 46616 and proceeding in a south-easterly direction along a sunken lane behind the gardens of Ganwick Close and Moneypiece Close for 155 metres to a point at OS Grid Ref TL 67030 46530; then changing to a south-westerly direction and passing between the Chapel Drive Estate and the Arrendene Estate to the junction with Bridleway 47 at a point at OS Grid Ref TL 66818 46299.
2. A spur commencing at a point at OS Grid Ref TL 67008 46507 and proceeding in a north-westerly direction for 3 metres.
3. A spur commencing at a point at OS Grid Ref TL 66977 46458 and proceeding in a north-westerly direction for 2 metres.
4. A spur commencing at a point at OS Grid Ref TL 66925 46404 and proceeding in a north-westerly direction for 2 metres.
5. A spur commencing at OS Grid Ref TL 66854 46344 and proceeding in a south-easterly direction for 2 metres,
6. A spur commencing at OS Grid Ref TL 66854 46334 and proceeding in a south-easterly direction for 2 metres.

Width of main route: between OS Grid Refs TL 66901 46616 and TL 67030 46530: 7.5 metres between OS Grid Refs TL 67030 46530 and TL 66818 46299: 5 metres.

Width of spurs: 2 metres.

Footpath 46

Commencing at the junction with Bridleway 47 at a point at OS Grid Ref TL 66801 46272 and proceeding in a south-westerly direction along the western side of Cangle Primary School and passing under the arch of the disused railway and across a culvert for 457 metres to the Withersfield Road at a point at OS Grid Ref TL 66716 46132.

Width: 5 metres.

Description of byway to be stopped up with reservation of bridleway

Bridleway 47

Commencing at the junction with Footpath 45 at a point at OS Grid Ref TL 66818 46299 and proceeding in a south-westerly direction along the western side of Cangle Primary School for 35 metres to the junction with Footpath 46 at OS grid Ref TL 66801 46272.
