THE STOPPING-UP OF HIGHWAYS (KINGSWAY SHOPPING CENTRE AND UNION LANE, NEWPORT) ORDER 2006

Notice is hereby given that the Minister for Enterprise, Innovation and Networks, acting on behalf of the National Assembly for Wales has made an Order under section 247 of the Town and Country Planning Act 1990, to authorise the stopping-up of the areas of highway described in Schedule 1 to this notice, to provide for the new area of highway described in Schedule 2 and to improve the area of highway described in Schedule 3.
The stopping-up is authorised only in order to enable the development described in Schedule 4 to this notice to be carried out in accordance with planning permission granted by Newport City Council on 12 January 2006 under Ref 05/0978. The Order will cease to have effect upon cessation of the planning permission.
During the 6 weeks from 12 April 2006, copies of the Order and the deposited plan may be inspected, free of charge, during normal office hours at the offices of Newport City Council, Law and Standards, Civic Centre, Newport, South Wales NP20 4UR, or may be obtained, free of charge, from the address below quoting the Welsh Assembly Government Ref CZ510-5-7-49.
If any person desires to question the validity of the Order, or of any of the Provisions contained therein, on the grounds:

(i) that it is not within the powers of the Town and Country Planning Act 1990; or
(ii) that their interests have been substantially prejudiced by a failure to comply with any of the requirements of the Act,

that person may, within 6 weeks of 12 April 2006, apply to the High Court for the suspension of quashing of the Order or of any provision contained therein.

Schedule 1
Description of the areas of highway to be stopped under this Order

An irregularly shaped area of highway forming part of Union Lane extending from its junction with Union Court in a north-easterly direction for a distance of 43.5 metres and having a maximum width of 25 metres and total area of 370 square metres (Area “A” on the deposited plan).
An irregularly shaped area of highway forming a circulatory area of carriageway internal to the existing closed car park, extending for 185 metres and having a maximum width of 16 metres and total area of 1,648 square metres (Area “B” on the deposited plan).
An irregularly shaped area of highway forming the eastern part of Union Lane and area fronting Kingsway, extending for 68 metres and having a maximum width of 25 metres and total area of 1,106 square metres (Area “C” on the deposited plan).
An irregularly shaped area of highway forming part of the existing Kingsway footway extending for 9 metres and having a maximum width of 8 metres and total area of 45 square metres (Area “D” on the deposited plan).
Schedule 2
Description of the area of new highway to be provided

An irregularly shaped area adjoining Union Court extending in a north-easterly direction for a distance of 31 metres and having a maximum width of 8 metres and total area of 317 square metres (Area “E” on the deposited plan).
Schedule 3
Description of the area of highway to be improved

An irregularly shaped area of highway adjoining Kingsway extending for 25 metres and having a maximum width of 25 metres and total area of 321 square metres (Area “F” on the deposited plan).
Schedule 4
Proposed Development

Erection of 9 level multi-storey car park and associated works including relocation of substation at Kingsway Shopping Centre, Newport.
