HIGHWAYS AT GERRARD STREET/GERRARD CLOSE, NEWTOWN, BIRMINGHAM

The Secretary of State hereby gives notice that he has made an Order under section 247 of the above Act entitled “The Stopping-up of Highways (City of Birmingham) (No 5) Order 2006” authorising the stopping-up of highways at Gerrard Street/Gerrard Close, Newtown, Birmingham.
The Order as made will authorise the stopping-up only to enable the development described in the Schedule to this notice to be carried out in accordance with the outline planning permission granted by Birmingham City Council on 24 June 2004, under Ref C/02652/04/FUL and the full permission on 24 January 2005.
Copies of this Order may be obtained, free of charge, on application to the Government Office for the West Midlands, Northern Division, 5 St Philip’s Place, Colmore Row, Birmingham B3 2PW (quoting Ref 5104/35/1/220) and may be inspected at all reasonable hours at Birmingham City Council, Planning Department, Alpha Tower, Suffolk Street, Queensway, Birmingham B1 1TU.
Any person aggrieved by the Order and desiring to question the validity thereof, or of any provision contained therein, on the grounds that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of 7 April 2006, apply to the High Court for the suspension or quashing of the Order or of any provisions contained therein.
