STOPPING-UP OF PART OF LOVERS LANE, SANDSIDE IN THE COUNTY OF CUMBRIA AND PEDESTRIANISATION OF PART OF QUARRY LANE, SANDSIDE IN THE COUNTY OF CUMBRIA

The Secretary of state for transport hereby gives notice that, on the application of Eversheds, he has made an Order under Section 247 and 333(7) of the above Act to vary “The Stopping-Up of Highways (County of Cumbria) (No 4) Order 2005” and an Order under section 249 of the above act to provide for the extinguishment of any rights persons may have to use vehicles on part of Quarry Lane, Sandside.
The section 247 Stopping-Up Order is permanent and has been authorised to enable the development described in the Planning Permission granted to Tarmac Northern Ltd by Cumbria County Council on 22 December 2004 under Ref 5/04/9003.
The section 249 Order comes into operation on the date mentioned below and extinguishes any right which persons may have to use vehicles (other than those specified in Schedule 2 to the Order) on part of Quarry Lane, Sandside.
Copies of the Orders may be obtained, free of charge, on application to the Government Office for the North West (Planning and Transport Casework), City Tower, Piccadilly Plaza, Manchester M1 4BE (quoting Refs GO/TNW 5049/35/1/96 and GO/TNW 5049/41/39/10).
They may also be inspected at all reasonable hours at the offices of Beetham Parish Council, Long Orchard, Beetham, Milnthorpe.
Any person aggrieved by the Order and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the power of the above act or any regulation made thereunder has not been complied with in relation to the Order, may within 6 weeks of 7 April 2006, apply to the High Court for the suspension or quashing of the Order or any provision contained therein.
Unless the section 249 Order is suspended or quashed as a consequence of any such application, any person who on the date mentioned above, had an interest in land having lawful access to a highway to which the Order relates may claim to be entitled to be compensated by Cumbria County Council in respect of any deprecation in the value of his or her interest which is directly attributable to the Order and of any other loss or damage which is so attributable. Any claim must be served on the Council at County Offices, Kendal, Cumbria LA9 4RQ within 6 months from the above-mentioned date unless the period is extended in any particular case by the Secretary of State.
