TRANSFER OF APPOINTMENTS BETWEEN OFFICE HOLDERS

Notice is hereby given that, pursuant to the Order of Mr Justice Peter Smith, sitting as a Judge of the High Court of Justice in the Chancery Division of the Royal Courts of Justice, London, on 6 October 2005, Nedim Patrick Ailyan (“Mr Ailyan”), Licensed Insolvency Practitioner and former partner of Begbies Traynor has been removed from the following offices: 1. As Joint Liquidator of those Companies in Creditors’ voluntary liquidation listed in Schedules A to C below. Mr Ailyan has not been replaced as matters are well advanced and do not require another joint appointee. 2. As Joint Liquidator of those Companies in Creditors’ voluntary liquidation listed in Schedule D below, David Paul Hudson (“Mr Hudson”), a Licensed Insolvency Practitioner and partner in Begbies Traynor, has been appointed Joint Liquidator in place of Mr Ailyan. 3. As sole Liquidator of Berkley International Plc. (in Creditors’ voluntary liquidation). Mr Hudson has been appointed sole Liquidator in place of Mr Ailyan. 4. As Joint Liquidator of those companies in compulsory liquidation listed in Schedule E below. Mr Ailyan has not been replaced as the matters are well advanced and do not require another joint appointee. 5. As sole Liquidator of Endoprime Ltd (in compulsory liquidation). Mr Hudson has been appointed sole Liquidator in place of Mr Ailyan. 6. As joint supervisor of the Company voluntary arrangements listed in Schedule G below. Mr Ailyan has not been replaced as matters are well advanced and do not require another joint appointee. 7. As Joint Administrator of Thames Shipping Services Ltd (in administration). Mr Ailyan has not been replaced as matters are well advanced and do not require another joint appointee. 8. As Joint Trustee in Bankruptcy of the estates of those individuals listed in Schedule I. Mr Ailyan has not been replaced as matters are well advanced and do not require another joint appointee. 9. As sole Trustee in Bankruptcy of the estates of the individuals listed in Schedule J below. Mr Hudson has been appointed sole Trustee in Bankruptcy in place of Mr Ailyan. 10. As joint supervisor of the individual voluntary arrangements listed in Schedule K below. Mr Ailyan has not been replaced as matters are well advanced and do not require another joint appointee. 11. As Joint Administrative Receiver of the administrative receiverships listed in Schedule L below. Mr Ailyan has not been replaced as matters are well advanced and do not require another joint appointee. Please note: 1. Any person affected by the Order is permitted to apply to vary or discharge the Order provided that such application is made within 28 days of this notice and on substantial grounds. 2. Mr Ailyan may apply to the Secretary of State for his release from liability in respect of the insolvency appointments listed in Schedules A to F and Schedules I to J below within 21 days of this notice, save in respect of any claims notified by that date. 3. Mr Ailyan will be released from liability in respect of his other appointments listed in Schedules G, H and K with effect from 28 days of this notice save in respect of claims notified by that date. 4. In the case of the estates in bankruptcy or in liquidation where there is a Creditors’ committee, it is open to the committee to require Mr Ailyan to provide an account of his administration for the insolvency, including summary of receipts and payments, and a statement that he has reconciled his account. Where there is no committee, a similar request may be made by an individual Creditor, but this will only be complied with if the Creditor applies to the Court within 28 days for such an Order and the Court grants it. Unless there are good reasons to the contrary, the costs which Mr Ailyan would incur in complying with any such requirement would be paid as part of the expenses of the individual insolvency. 5. Creditors of any estate in liquidation or bankruptcy affected by the Order are reminded that they may also call for a statement of receipts and payments under regulations 11 and 25 respectively of the Insolvency Regulations 1994.
