THE A46 TRUNK ROAD (A46/A607 HOBBY HORSE ROUNDABOUT JUNCTION IMPROVEMENT) COMPULSORY PURCHASE ORDER (TD NO 09) 2005

Notice is hereby given that the Secretary of State for Transport in exercise of his powers under the above Acts, on 7 March 2005 made the A46 Trunk Road (A46/A607 Hobby Horse Roundabout Junction Improvement) Compulsory Purchase Order (TD No 09) 2005. The Order as made provides for the purchase for the purpose of: (a) the land and rights described in Schedule 1 hereto for the purposes of: (i) the improvement of the A46 Bath-Lincoln Trunk Road at Syston in the district of Charnwood in the county of Leicestershire, (ii) the improvement of highways at Syston in the district of Charnwood in the county of Leicestershire in the pursuance of the A46 Trunk Road (A46/A607 Hobby Horse Roundabout Junction Improvement Side Roads) Order 2005, (iii) use by the Secretary of State in connection with those improvements; and (b) the land and rights described in Schedule 2 hereto for the purpose of mitigating any adverse effect which the existence or use of the said Trunk Road and other highways which he proposes to improve as aforesaid will have on the surrounding thereof. A copy of the Order as made and of the map referred to therein have been deposited at the offices of the Highways Agency, 5 Broadway, Broad Street, Birmingham B15 1BL; Syston Library, Upper Church Street, Syston, Leicestershire LE7 1HR; Syston Post Office, 14 High Street, Syston, Leicestershire LE7 1GP and at Syston Town Council, Community Centre, School Street, Syston, Leicestershire LE7 1HN and may be seen there at all reasonable hours. The Order as made becomes operative on the date on which this notice is first published; but a person aggrieved by the Order, may by application to the High Court within 6 weeks from that date, question its validity on the grounds that the authorisation granted by the Order is not empowered to be granted or that there has been a failure to comply with any relevant statutory requirement relating to the Order. Schedule 1 Note: (a) The land comprised in each item in this Schedule is identified in the plan referred to in the Compulsory Purchase Order by means of the numbers shown in brackets against the item in this Schedule. (b) References to ownership are references to ownership or reputed ownership at the time of the preparation of the Compulsory Purchase Order and are stated only for the purposes of identification of the land. In the parish of Syston in the district of Charnwood in the county of Leicestershire Pasture land and access track from its junction with the south west corner of the A46/A607 junction (owner of the land Raynesway Properties Ltd) (1/1). Pasture land and access track from its junction with the north west corner of the A46/A607 junction, pasture land to the west of the A46 north of the junction with the A607 (all owned by Pontylue Developments Company Ltd) (1/2 and 1/2A). Body of water and banks north east corner of the A46/A607 junction (owner of the land Lafarge Aggregates Ltd) (1/3). Pasture land to the east of the A46 north of the junction with the A607 (owner of the land David Wilson Homes) (1/4).
