THE LONDON BOROUGH OF MERTON (CONTROLLED ZONES) (PARKING PLACES) (MP1) (AMENDMENT NO 2) ORDER 2005

1. Notice is hereby given that the London Borough of Merton, after consulting the Commissioner of Police of the Metropolis, have made the above mentioned Orders under sections 6 and 124 and Part IV of Schedule 9 of, the Road Traffic Regulation Act 1984, as amended by the Local Government Act 1985 and the Road Traffic Act 1991. 2. The general effect of the Orders will be: (a) to introduce waiting restrictions operating at all times in the roads specified in Schedule 1 to this notice; (b) to introduce permit parking bays in the road specified in Schedule 2 to this notice operating between 10.00 am and 4.00 pm, Mondays to Fridays inclusive. 3. Nothing in these Orders will apply to anything done with the permission or at the direction of a police constable in uniform. 4. Exemptions to Item 2(a) above are provided in the Orders to permit vehicles to wait: (a) to enable passengers to board or alight and to load or unload their personal luggage; (b) for up to 20 minutes for the purpose of delivering and collecting goods or loading/unloading the vehicle at premises adjacent to the street; (c) if they are being used to maintain the road or the services therein or by local authorities or the Post Office in pursuance to statutory powers and duties; (d) if being used for fire brigade, police or ambulance purposes. 5. A copy of the Orders, a plan identifying the areas affected by the Orders and the Council’s statement of reasons for making the Orders can be inspected during the Council’s normal office hours Mondays to Fridays at the Merton Link, Merton Civic Centre, London Road, Morden, Surrey. 6. Any person desiring to question the validity of these Orders or of any provision contained in them on the grounds that it is not within the powers conferred by the Road Traffic Regulation Act 1984, or on the grounds that any requirement of the Act, or of any Instrument made under it has not been complied with in relation to the Orders, may, within 6 weeks from the date which the Orders were made, apply to the High Court for this purpose. Schedule 1 Waiting Restrictions operating at all times Charnwood Avenue —Cul-de-sac: (a) North Side; From its junction with Sandbourne Avenue to a point 5 metres west of the party wall of Nos 12 and 14 Charnwood Avenue From a point 1 metre east of the party wall of No 16 Charnwood Avenue westwards to a point 1 metre west of the common boundary of Nos 18 and 20 Charnwood Avenue. From a point 1 metre east of the party wall of No 20 Charnwood Avenue westwards to a point 1 metre west of the party wall of No 22 Charnwood Avenue. From a point 2 metres east of the party wall of No 24 Charnwood Avenue westwards to the common boundary of Nos 25 and 27 Charnwood Avenue. (b) South Side; From its junction Sandbourne Avenue westwards for a distance of 6 metres. Sandbourne Avenue, West side, from a point 12 metres south of the southern kerbline of Charnwood Avenue to a point 13 metres north of the northern kerbline of Charnwood Avenue. Waiting Restrictions Operating Between 10.00am and 4.00pm, Monday to Friday Inclusive Charnwood Avenue —Cul de sac: North Side; From a point 5 metres west of the common boundary of 12 and 14 Charnwood Avenue westwards to a point 1 metre east the party wall of No 16 Charnwood Avenue. From a point 1 metre west of the common boundary of Nos 18 and 20 Charnwood Avenue westwards to a point 1 metre east of the party wall of No 20 Charnwood Avenue. From a point 1 metre west of the party wall of No 22 Charnwood Avenue westwards to a point 2 metres east of the party wall of No 24 Charnwood Avenue. South Side; From a point 6 metres from its junction with Sandbourne Avenue westwards to a point opposite the party wall of 25 and 27 Charnwood Avenue.
