PEDESTRIANISATION OF HIGHWAYS AT CHESTER IN THE COUNTY OF CHESHIRE

The Secretary of State gives notice that, on the application of Chester City Council, he has made an Order under section 249 of the above Act entitled “The Extinguishment of Vehicular Rights (County of Cheshire) 2) Order 2005”.
This Order comes into operation on the date mentioned below and extinguishes any right which persons may have to use vehicles (other than those specified in Schedule 2 to this Order) on lengths of Leadworks Lane, Chester.
Copies of the Order may be obtained, free of charge, on application to the Government Office for the North West (Transport), Sunley Tower, Piccadilly Plaza, Manchester M1 4BE (quoting Ref GO/TNW 5046/41/39/2). It may also be inspected at all reasonable hours at the offices of Chester City Council, The Forum, Chester.
Any person aggrieved by the Order and desiring to question its validity, or the validity of any provision contained in it, on the ground that it is not within the power conferred by the Act or that any requirement of that Act, or of any Regulation made under it has not been complied with in relation to the Order, he or she may, within 6 weeks from 15 February 2005, apply to the High Court for the suspension or quashing of the Order or of any provision contained in it.
Unless the Order is suspended or quashed as a consequence of any such application, any person who on the date mentioned above, had an interest in land having lawful access to a highway to which the Order relates may claim to be entitled to be compensated by Cheshire County Council in respect of any depreciation in the value of his or his interest which is directly attributable to the Order and of any other loss or damage which is so attributable. Any claim must be served on the Council at its above address within a period of 6 months from the above-mentioned date unless the period is extended in any particular case by the Secretary of State.
