THE A63 TRUNK ROAD (OSGODBY BYPASS SIDE ROADS) ORDER 2004

The Secretary of State for Transport hereby gives notice that he has made the following Orders: 1. An Order under sections 10 and 41 of the Highways Act 1980, entitled “The A63 Trunk Road (Osgodby Bypass) Order 2004”, which will provide that a road which he proposes to construct along the following route at Osgodby in the district of Selby in the county of North Yorkshire shall become a trunk road from the date when the Order comes into force: a route about 1.5 kilometres in length from its western junction with the A63 Selby Bypass and the A19 Junction (roundabout), south of the existing A19 and the A63 Trunk Roads at Barlby Junction, to a point on the existing A63 Trunk Road (Hull Road) northwest of Becksyke Farm, south-east of Osgodby in the district of Selby. 2. An Order under sections 10 and 12 of the Highways Act 1980, entitled “The A63 Trunk Road (Barlby Junction To Bridge Farm) (Detrunking) Order 2004”, which will provide that the A63 Trunk Road (Hull Road) about 1.4 kilometres in length from its junction with the A19 Trunk Road at Barlby junction to a point 65 metres south-east of Bridge Farm south of Osgodby in the parish of Barlby in the district of Selby in the county of North Yorkshire shall cease to be a trunk road, and shall be classified as a classified road, as from the date on which the Secretary of State for Transport notifies North Yorkshire County Council who will become the highway authority responsible for that length that the new trunk road on the main route is open for traffic. 3. An Order under sections 14 and 125 of the Highways Act 1980, in relation to the A63 Trunk Road and the new trunk road to be constructed by him at Osgodby in the district of Selby in the county of North Yorkshire. This Order is entitled “The A63 Trunk Road (Osgodby Bypass Side Roads) Order 2004” and it: (1) authorises him to: (a) stop up a highway, (b) construct new highways, (c) stop up private means of access to premises, (d) provide new means of access to premises, all in the parish of Barlby in the district of Selby in the county of North Yorkshire. Copies of each Order and the plan referred to in it have been deposited at the offices of the Highways Agency, Traffic Operations Division North, City House, New Station Street, Leeds LS1 4UR; at the offices of North Yorkshire County Council, County Hall, Northallerton DL7 8AD; at Selby District Council, Civic Centre, Portholme Road, Selby YO8 0SB; at Barlby Library, Howden Road, Barlby, Selby YO8 5JE, and at Osgodby Village store, 36 Hull Road, Osgodby, Selby YO8 5HG. Copies of the Orders numbered 1 and 2 above can be purchased through booksellers or direct from government bookshops (The Stationery Office). They are respectively numbered SI 2004/3436 and SI 2004/3435 and priced £3 each. Copies of the Order numbered 3 above can be obtained from the Highways Agency, Traffic Operations Division North, City House, New Station Street, Leeds LS1 4UR Any person aggrieved by an Order mentioned in this notice who desires to question its validity, or the validity of any provision in it, on the grounds that: (a) it is not within the powers of the Highways Act 1980, or (b) any requirement of that Act or of regulations made under that Act has not been complied with in relation to that Order, may apply to the High Court within 6 weeks from the date of first publication of this notice.
