TOWN AND COUNTRY PLANNING (GENERAL PERMITTED DEVELOPMENT) ORDER 1995
PROPERTIES WITHIN THE ST MARY MAGDALENE CONSERVATION AREA IN THE LONDON BOROUGH OF ISLINGTON
DIRECTION MADE UNDER ARTICLE 4(2)

The Council of the London Borough of Islington being satisfied that the development as described in Schedule 1 below should not be carried out on the land described in Schedule 2 below; acting under the powers conferred on them by Articles 4(2) and 6(7) of the Town and Country Planning (General Permitted Development) Order 1995 (“the Order”); directs that the permission granted by Article 3 of the Order should not apply in respect of those works listed in Schedule 1 in respect of the land within the St Mary Magdalene Conservation Area listed in Schedule 2 below. Schedule 1 Development not to be carried out In respect of land described in Schedule 2 below, the development referred to in the following parts and classes of Schedule 2 of the Order, that is to say: 1.  Part 1 Class A The enlargement, improvement or other alteration of a dwelling house where any part of the enlargement, improvement or alteration would front the highway. 2.  Part 1 Class C Any alteration to the roof of a dwelling house where the relevant roof slope fronts the highway. 3.  Part 1 Class D The erection or construction of a porch outside any external door of a dwelling house which fronts the highway. 4.  Part 1 Class F The provision within the curtilage of a dwelling house of a hard surface for any purpose incidental to the dwelling house where the hard surface would front a highway. 5.  Part 1 Class H The installation, alteration or replacement of satellite antenna on a dwelling house or within the curtilage of a dwelling house, where the part of the building or other structure on which the satellite antenna is to be installed, altered or replaced, fronts the highway. 6.  Part 1 The erection, alteration or removal of a chimney on a dwelling house or on a building within the curtilage of a dwelling house. 7.  Part 2 Class A The erection, construction, improvement or alteration of a gate, fence, wall or other means of enclosure where the gate, fence, wall or other means of enclosure would be within the curtilage of a dwelling house and would front the highway. 8.  Part 2 Class C The painting of the exterior of a dwelling house or any building or enclosure within the curtilage of a dwelling house consisting of the painting of any part of the exterior which fronts a highway which is previously unpainted. 9.  Part 31 Class B The demolition of the whole or any part of any gate, fence, wall or other means of enclosure within the curtilage of a dwelling house and fronting the highway. The decisions to make the Direction were made by the Council’s East and West Area Planning Sub Committees on 3 March 2003. The effect of the Direction is that specific planning permission is required for the works listed in Schedule 1 above in respect of those properties listed in Schedule 2 above. The Direction shall expire on 23 October 2003 which is six months from the date on which it was made, unless confirmed by the Council before that date. A copy of the Direction and a map defining the area to which it relates may be viewed at the Municipal Offices, 222 Upper Street, London N1, between 9.00 am and 4.30 pm Monday to Friday. The Direction will be explained at a public meeting at Islington Town Hall, Upper Street, London N1, at 7.00 pm on Wednesday 21 May 2003.
