THE CITY OF WESTMINSTER (FREE PARKING PLACE) (DISABLED PERSONS) (NO 1) EXPERIMENTAL TRAFFIC ORDER 2003

1. Notice is hereby given that the Westminster City Council, on 19 March 2003, made the above-mentioned Orders under section 9 of Schedule 9 to, the Road Traffic Regulation Act 1984 as amended by the Local Government Act 1985. 2. The general effect of the Parking Place Order will be to experimentally provide a 1-hour pay and display parking place on the north-east side of Arlington Street between Bennett Street and Piccadilly. 3. The general effect of the Waiting and Loading Restriction Order will be to further amend the City of Westminster (Waiting and Loading Restriction) (No 1) Order 2002, so that: (a) in the lengths of street specified in Schedule 1 to this notice, the hours during which the existing prohibition applies on: (i) waiting by vehicles (otherwise than for the purpose of delivering, or collecting goods or loading or unloading a vehicle) will be changed so that it will apply at any time; (ii) waiting by vehicles for more than 20 minutes in the same place for the purpose of delivering or collecting goods or loading or unloading a vehicle will be changed so that it will apply between 11.00 am and 6.30 pm throughout the week. (b) in the lengths of street specified in Schedule 2 to this notice the loading restrictions will be revoked. 4. The general effect of the Disabled Persons’ Parking Place Order will be to experimentally provide: (a) a disabled person’s parking place on the north-east side of Arlington Street; (b) that the vehicles which may be left in the disabled person’s parking place shall be those displaying either a valid permit issued by the Westminster City Council (commonly known as the “White Westminster Exemption Badge”) or a disabled persons’ badge issued by any local authority (commonly referred to as “the blue badge”) and that they may be left without charge. 5. The Orders provide that subject to the provisions of section 10 of the Road Traffic Regulation Act 1984, the Council’s Acting Director of Planning and Environment for the time being, or some person authorised in that behalf by him, may, if it appears to him or that person essential: (a) in the interests of the expeditious, convenient and safe movement of traffic; (b) in the interests of providing suitable and adequate parking facilities on the highway; or (c) for preserving or improving the amenities of the area through which any road affected by any of the Orders run, modify or suspend the operation of any of the Orders or any provision contained therein. 6. Copies of the Orders and of other documents giving more detailed particulars of the Orders can be inspected between 9.00 am and 5.00 pm, on Mondays to Fridays, from 31 March 2003 until such time as the Orders cease to have effect, at Parkman Ltd., Third Floor, Mountbarrow House, 6-20 Elizabeth Street, London SW1W 9RB. 7. Any person desiring to question the validity of any of the Orders or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984 or that any of the relevant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to the Orders may make application for the purpose to the High Court by 30 April 2003. 8. If the provisions of the Orders continue in force for a period of not less than 6 months, the Council will consider in due course whether the provisions of the Order should be reproduced and continued in force indefinitely by means of Orders under sections 6 and 45 of the said Act of 1984. Anyone who wishes to object to the making of Orders under sections 6 and 45 of the said Act of 1984 for the purpose of such reproduction and continuation in force may, between 31 March 2003 and 30 September 2003 inclusive, send a statement in writing of their objection and the grounds thereof to the Council’s agents, Parkman Ltd., Third Floor, Mountbarrow House, 6-20 Elizabeth Street, London SW1W 9RB, quoting Ref 1000943/2174/ORD2848/rtp. C Powell, Director of Planning and Transportation (the Officer appointed for this purpose). Schedule 1 Arlington Street, the north-east side, between the south-eastern kerbline of Bennett Street and a point 18 metres south-east of that kerbline, the south-west side, between a point 5 metres south-east of the south-eastern kerbline of Piccadilly and a point 38 metres south-east of that kerbline. Schedule 2 Arlington Street, the north-east side, between a point 5 metres south-east of the south-eastern kerbline of Piccadilly and a point 45.7 metres south-east of that kerbline, the north-east side, between a point 6 metres north-west of the north-western kerbline of Bennett Street and a point 9.1 metres north-west of that kerbline. 20 March 2003.
