THE ISLINGTON (BUS PRIORITY) (AMENDMENT NO 4) TRAFFIC MANAGEMENT ORDER 2003
NO 691 RELATING TO NEWINGTON GREEN AND MILDMAY PARK N1

1. Notice is hereby given that the Islington Borough Council made the above-mentioned Order on 10 March 2003 under section 6 of the Road Traffic Regulation Act 1984, as amended by the Local Government Act 1985 and the Road Traffic Act 1991.
2. The general effects of the Bus Lane Order which comes into force on 14 March 2003, will be to vary the existing Bus Lanes Order to create new sections of Bus Lane as follows:

(a) the west side of Newington Green Road between Bingham Street and Grosvenor Avenue;
(b) the west side of Mildmay Park between Mildmay Grove North and Newington Green;
(c) the east side of Mildmay Park between Balls Pond Road and Mildmay Grove North.

The width of these sections of bus lane will not exceed 3.2 metres and will be operational Monday to Friday from 2(a) and (b) between 4.00 pm to 7.00 pm and 2(c) between 7.00 am to 10.00 am.
3. The prohibitions would not apply to:

(a) a local service, a schedule express carriage, a school bus or a work bus; or
(b) a coach;
(c) a dial-a-ride vehicle (a vehicle providing a service for the carriage of disabled persons and those accompanying them); or
(d) a pedal cycle; or
(e) a taxi cab;
(f) a vehicle being used for ambulance, fire brigade or police purposes
(g) any vehicle being used in connection with the removal of any obstruction in a bus lane; or
(h) a vehicle being used for purposes in connection with the statutory powers and duties of a local authority or the supply of gas, water or electricity, or in connection with any building operation, demolition or excavation in or adjacent to a bus lane;
(i) a vehicle of the Royal Mail Service;
(j) any vehicle which enters the bus lane for the sole purpose of waiting for as long as may be reasonably necessary to assist a disabled person;
(k) any vehicle which enters or proceeds in the bus lane:

(i) from any road if that vehicle forthwith leaves the bus lane through any gap in the longitudinal single white line or through the broken white line situated opposite and adjacent to the junction of that road with that bus lane, or if there is no such gap or broken white line, at a point opposite the road; or
(ii) from any part of Newington Green Road and Mildmay Park which is not comprised in the bus lane through any gap in the longitudinal single white line situated opposite and adjacent to that gap or broken white line if that vehicle forthwith enters the road which lies opposite and adjacent to that gap or broken white line, at a point opposite that road if the vehicle forthwith enters that road; or
(iii) from any vehicular accessway or crossing over the footway adjoining the bus lane if that vehicle forthwith leaves the bus lane at a point opposite that vehicular accessway or crossing; or
(iv) from any part of Newington Green Road and Mildmay Park which is not comprised in the bus lane at a point opposite any vehicular accessway or crossing over the footway adjoining the bus lane if the vehicle forthwith leave the bus lane at a point opposite that vehicular accessway or crossing;

3. The prohibitions referred to in item 2 of this notice will not apply in relation to anything done with the permission or at the direction of a police officer in uniform.
4. A copy of the made Order, of plans indicating details of the measures referred to above, and of the Council’s statement of reason for making the Order, can be inspected during normal office hours until the end of a 6 week period from the date on which the Order was made or, at the following location;

5. Any person desiring to question the validity of the Order or any provision contained therein on the grounds that it is not within the relevant requirements thereof any relevant regulations made thereunder have not been complied with in relation to the Order may, within 6 weeks of the date on which the Order was made, make application for the purpose to the High Court.
