EXPERIMENTAL EXTENSION OF CANADA WATER CONTROLLED PARKING ZONE (CPZ “H”)

1. Notice is hereby given that the Council of the London Borough of Southwark on 6 March 2003 made the London Borough of Southwark (Waiting Restrictions and Parking Places) (CPZ “H”) Extension) Experimental Traffic Order 2003 under section 9 of the Road Traffic Regulation Act 1984, as amended. The Order will come into force on 17 March 2003 and will continue in force for a maximum of 18 months. 2. In brief, the general nature and effect of the Order will be, as an experiment, to extend the existing Canada Water controlled parking zone (CPZ“H”) into an area on the south-west side of Lower Road, which includes Lower Road (the south-west side, between the common boundary of Rotherhithe Free Church and St Olave’s Nursing Home and the north-western kerbline of Orange Place), Ann Moss Way and Gomm Road. The Order will provide that: (a) parking places will be provided on the streets specified in Schedules 1 to 4 of this notice; (b) the vehicles which may use the parking places while they are in operation will be those described at the beginning of each Schedule (and the classes of the vehicles described in Schedule 1 of this notice will be passenger vehicles—having 8 passenger seats or less, certain goods carrying vehicles, motor cycles and invalid carriages); (c) the parking places on the streets specified in Schedules 1 or 2 of this notice will operate between 8 am and 6.30 pm on Mondays to Fridays, the parking places specified in Schedules 3 or 4 of this notice will operate at all times; (d) permits would be issued, on payment of the appropriate charge, to a person who is the keeper of a vehicle of a class referred to in sub-paragraph (b) above and providing: (i) in the case of a resident’s permit, that they are a resident of any street within either the existing controlled parking zone “H” or the extended area referred to in paragraph 2 above (maximum of three residents’ permits will be issued per household); (ii) in the case of a business permit, that they have a business in any street referred to in sub-paragraph (i) above and the vehicle in respect of which the permit is issued is essential for the operation of the business and it is used for the purchase or sale of goods or services; (iii) in the case of a visitor’s permit, that they are a resident of any street referred to in sub-paragraph (i) above and that such a permit is to be used by a bona fide visitor to their home; (e) the charge for a pay and display ticket referred to in Schedule 1 to this notice will be at the rate of 20 pence for 10 minutes (£1.20 per hour) for up to a maximum parking period of 4 hours, with no return to the parking place within 2 hours of leaving it; (f) charges for permits will be as follows:—(i) for a resident’s permit for a vehicle other than a motorcycle; £8, £22, £40 and £76 for 1, 3, 6 and 12 months respectively, and for motorcycles: £19 for 12 months; (ii) for a business permit: £65, £130 and £255 for 3, 6 and 12 months respectively (12 monthly residents’ and business permits will also be available for “environmentally friendly” vehicles at a discounted charge of £19 and £63.75 respectively); (iii) for visitors’ permits (which will each be valid for 1 day): £12 for the first book of 10 permits and after that £30 for each subsequent book of 10 permits; (g) there will be no charge for the use of the parking places referred to in Schedule 2, 3 or 4 of this notice; (h) vehicles displaying a disabled person’s badge will be permitted to use the parking places referred to in Schedule 1 to his Notice without charge or time limit; (i) new restrictions on waiting by vehicles will apply in the controlled parking zone extension either between 8.00 am and 6.30 pm on Mondays to Fridays (zone hours) or at any time in areas where it is considered dangerous to allow parking. 3. For further information about the Order or to gain a copy of the Order, please telephone The Project Centre Limited on 020 7430 6917/6963, during normal office hours. 4. Documents giving more detailed particulars of the Order (including drawings showing the parking places and waiting restrictions) are available for inspection during normal office hours from 7 March 2003 until the Order ceases to have effect, at Southwark Regeneration and Environment Department, Council Offices, Chiltern House, Portland Street, London SE17 2ES. 5. Southwark Borough Council will be considering in due course whether the provisions of the experimental Order should be continued in force indefinitely by means of a permanent Order made under sections 6, 45, 46 and 49 of the Road Traffic Regulation Act 1984. Any person may object to the making of such a permanent Order within a period of 6 months beginning with the day on which the experimental Order comes into force or, if the Order is varied by another Order or modified pursuant to section 10(2) of the 1984 Act, beginning with the day on which the variation or modification or the latest variation or modification came into force. Any such objection must be in writing and must state the grounds on which it is made and be sent to the Council’s agents at the following address: The Project Centre Limited, Saffron Court, 14 b St Cross Street, London EC1N 8XA, quoting Ref PCL/TMO/CPZ “H” Extension. Any objection may be seen by, or be communicated to, any person who has an interest in this matter. 6. If any person wishes to question the validity of the Order or of any of its provisions on the grounds that it or they are not within the powers conferred by the Road Traffic Regulation Act 1984, or that any requirement of that Act or of any instrument made under that Act has not been complied with, that person may, within 6 weeks from the date on which the Order is made, apply for the purpose to the High Court. Schedule 3 Street on which parking places will be provided for the use of vehicles displaying a disabled person’s badge, in accordance with the regulations relating to the use of such a badge: Gomm Road.
