COMMENCEMENT OF PROVISIONS OF THE HEALTH PROFESSIONS ORDER 2001
THE HEALTH PROFESSIONS ORDER 2001 (S.I. 2002 NO 254)
In accordance with article 1(2) and (3) of the Health Professions Order 2001, the
Department of Health hereby gives notice that the Secretary of State for Health has
specified 14 March 2003 as the day for the coming into force of the following provisions
of the Health Professions Order 2001:
(1) For the purpose of the making of an Order by the Privy Council in relation to
the register:
(a) Article 6; and
(b) article 2 and Schedule 3 in so far as they relate to the definition of “register”.
(2) For the purpose of making rules, Articles:
5(2)b and (3)(a) (requirements as to evidence of good health and good character)
and (4) details of registrant shown in the register);
7 (form of register, applications for registration and fees);
9(2)(a)(i) (period within which qualification relied on must have been awarded);
10(1), (2)(b) and (c) and (3) (application for renewal);
11 (lapse of registration);
12(1)(c)(iii) (requirements as to knowledge of English);
22(4) (failure to comply with standards of conduct, performance and ethics);
23 (appointment of Screeners);
24 (procedure for Screeners);
26(2)(a), (3) and (4) (procedure for Investigating Committee);
30(9) (review of orders by a Practice Committee);
32 (procedure for investigation of allegations by Health Committee and Conduct and
Competence Committee);
33(4) and (7)(a) (application for restoration to the register);
34(4) (functions of legal assessors);
35(3) (functions of medical assessors);
36(3) (functions of registrant assessors);
37(1), (4) and (5) (registration appeals); and
for that purpose, Schedule 3 and Article 2 in so far as it relates to it.
(3) For the purpose of the making of an Order by the Privy Council with regard to
the functions of legal assessors, Article 40(1) (Order in respect of legal assessors).
(4) For the purpose of establishing standards of proficiency and prescribing requirements
under Article 5(2) and establishing standards and requirements under Articles 15(1)
and 19(4) and (6), Article 14 (advice by the Education and Training Committee).
(5) For the purpose of establishing standards and requirements under Article 15(1),
paragraph (3) of that Article (consultation).
(6) For the purpose of establishing standards and arrangements under Article 21(1)
and giving guidance under Article 21(1) or (2), paragraph (3) of that Article (consultation).

Note: The professions to which this Order applies are arts therapists; chiropodists; clincal
scientists; dietitians; medical laboratory technicians; occupational therapists; orthoptists;
paramedics; physiotherapists; prosthetists and orthotists; radiographers; and speech
and language therapists.
