THE CITY OF WESTMINSTER (WAITING AND LOADING RESTRICTION) (NO 2) EXPERIMENTAL TRAFFIC ORDER 2003
VICTORIA STREET AND PALACE STREET

1. Notice is hereby given that the Westminster City Council on 5 March 2003, made the above-mentioned Order under section 9 of Schedule 9 to the Road Traffic Regulation Act 1984, as amended by the Local Government Act 1985. 2. The general effect of the Waiting and Loading Order will be to experimentally amend the City of Westminster (Waiting and Loading Restriction) (No 1) Order 2002, so that: (a) in the lengths of streets specified in Schedule 1 to this notice, the hours during which the existing prohibition applies on waiting by vehicles (other than for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be changed so that it will apply at any time; (b) in the lengths of street specified in Schedule 2 to this notice, the hours during which the existing prohibition applies on waiting by vehicles, including waiting for the purpose of delivering or collecting goods or loading or unloading a vehicle, will be changed so that it will apply at any time; (c) in the lengths of streets specified in Schedule 3 to this notice, the hours during which the existing prohibition applies on waiting by vehicles (other than for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be changed so that it will apply between 7.00 am and 7.00 pm on Mondays to Fridays; (d) in the lengths of streets specified in Schedule 4 to this notice, the hours during which the existing prohibition applies on waiting by vehicles, including waiting for the purpose of delivering or collecting goods or loading or unloading a vehicle, will be changed so that it will apply between 7.00 am and 7.00 pm on Mondays to Fridays. 3. The Order provides that subject to the provisions of section 10 of the Road Traffic Regulation Act 1984, the Council’s Director of Planning and Transportation, or some person authorised in that behalf by him, may, if it appears to him or that person essential: (a) in the interests of the expeditious, convenient and safe movement of traffic; (b) in the interests of providing suitable and adequate parking facilities on the highway; or (c) for preserving or improving the amenities of the area through which any road affected by the Order runs, modify or suspend the operation of the Order or any provision contained therein. 4. Copies of the Order which will come into force on 14 March 2003 and of other documents giving more detailed particulars of the Order can be inspected between 9.00 am and 5.00 pm on Mondays to Fridays, from 14 March 2003, until such time as the Order ceases to have effect at Parkman Ltd., Third Floor, Mountbarrow House, 6-20 Elizabeth Street, London SW1W 9RB. 5. Any person desiring to question the validity of the Order or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984, or that any of the relevant regulations made thereunder has not been complied with in relation to the Order may make application for the purpose to the High Court by 16 April 2003. 6. If the provisions of the Order continue in force for a period of not less than 6 months, the Council will consider in due course whether the provisions of the Order should be reproduced and continued in force indefinitely by means of an Order under section 6 of the said Act of 1984. Anyone who wishes to object to the making of an Order under section 6 of the said Act of 1984 for the purpose of such reproduction and continuation in force may, between 14 March 2003 and 13 September 2003 inclusive, send a statement in writing of their objection and the grounds thereof to the Council’s agents, Parkman Ltd., Third Floor, Mountbarrow House, 6-20 Elizabeth Street, London SW1W 9RB, quoting the Ref /ORD2821/djc. C Powell, Director of Planning and Transportation (the Officer appointed for this purpose). Schedule 1 Waiting restrictions (“At any time”) 1.  Palace Street, the east side, between the northern kerbline of Victoria Street and a point 34.5 metres north of that kerbline. 2.  Victoria Street : (a) between its junction with Broad Sanctuary and a point 44.2 metres north-east of a point opposite the party wall of No 20 and Nos 10 to 18 Victoria Street; (b) the north side: (i) between a point 15 metres west of the western kerbline of Palace Street and a point 15 metres east of the eastern kerbline of Palace Street; (ii) between a point 34 metres east of the eastern boundary wall of No 62 Victoria Street and a point 30 metres west of the western kerbline of Buckingham Gate; (e) the south side, between a point 13 metres west of the western kerbline of Thirleby Road and a point 16 metres east of the eastern kerbline of Thirleby Road. Schedule 2 Loading Restrictions (At any time) Victoria Street: (a) the north side: (i) between a point 15 metres west of the western kerbline of Palace Street and a point 15 metres east of the eastern kerbline of Palace Street; (ii) between a point 15 metres west of the western kerbline of Buckingham Gate and a point 15 metres east of the eastern kerbline of Buckingham Gate; (iii) between a point 41 metres east of the eastern kerbline of Buckingham Gate and its junction with Broad Sanctuary; (b) the south side: (i) between a point 13 metres west of the western kerbline of Thirleby Road and a point 16 metres east of the eastern kerbline of Thirleby Road; (ii) between a point 30 metres west of the western kerbline of Artillery Row and a point 17 metres east of the eastern kerbline of Artillery Row; (iii) between a point 42 metres east of the eastern kerbline of Artillery Row and a point 30 metres east of the eastern kerbline of Strutton Ground; (iv) between a point 1 metre west of the eastern boundary wall of No 25 Victoria Street and its junction with Broad Sanctuary. Schedule 3 Waiting restrictions (7.00 am to 7.00 pm on Mondays to Fridays inclusive) Victoria Street: (a) the north side: (i) between a point 35 metres east of the eastern kerbline of Bressenden Place and a point 15 metres west of the western kerbline of Palace Street; (ii) between a point 15 metres east of the eastern kerbline of Palace Street and a point 34 metres east of the eastern boundary wall of No 62 Victoria Street; (b) the south side: (i) between a point 75 metres east of the eastern kerbline of Bressenden Place and a point 13 metres west of the western kerbline of Thirleby Road; (ii) between a point 16 metres east of the eastern kerbline of Thirleby Road and a point 99.4 metres west of the western kerbline of Artillery Row; (iii) between a point 87.5 metres west of the western kerbline of Artillery Row and a point 30 metres west of that kerbline. Schedule 4 Loading restrictions (between 7.00 am and 7.00 pm on Mondays to Fridays inclusive) Victoria Street: (a) the north side: (i) between a point 35 metres east of the eastern kerbline of Bressenden Place and a point 15 metres west of the western kerbline of Palace Street; (ii) between a point 15 metres east of the eastern kerbline of Palace Street and a point 15 metres west of the western kerbline of Buckingham Gate; (iii) between a point 15 metres east of the eastern kerbline of Buckingham Gate and a point 41 metres east of that kerbline; (b) the south side: (i) between a point 75 metres east of the eastern kerbline of Bressenden Place and a point 13 metres west of the western kerbline of Thirleby Road; (ii) between a point 16 metres east of the eastern kerbline of Thirleby Road and a point 30 metres west of the western kerbline of Artillery Row. 6 March 2003.
