THE STOPPING-UP OF HIGHWAYS (LONDON BOROUGH OF HAMMERSMITH AND FULHAM) (NO 1) ORDER 2002
TRAFFIC MANAGEMENT ORDER

The Council of London Borough of Hammersmith and Fulham makes this Order in exercise of their powers under section 247 of the Town and Country Planning Act 1990 (“the Act”) and of all other enabling powers: 1. The Council of London Borough of Hammersmith and Fulham authorises the stopping-up of the length of highway described in the Schedule to this Order and shown hatched black on the deposited plan, in order to enable development to be carried out in accordance with the deemed planning permission granted under part III of the Act to S.Mellor Lyric Theatre by London Borough of Hammersmith and Fulham, on 31 January 2002, application number 2001/2982/P. 2. Where immediately before the date of this Order there is any apparatus of statutory undertakers under, in, on, over, along or across any length of highway authorised to be stopped up pursuant to this Order then, subject to the section 261(4) of the Act, those undertakers shall have the same rights as respects that apparatus after that length of highway is stopped up as they have immediately beforehand. 3. In this Order: “the Council” means the London Borough of Hammersmith and Fulham; “the deposited plan” means the plan numbered “E1001” marked “The Lyric Theatre Hammersmith” signed by the authority of the Council and deposited at the third floor of London Borough of Hammersmith and Fulham, Town Hall Extension, King Street, London W6 9JU. 4. This Order comes into force on the date on which notice that it has been made is first published in accordance with section 252(10) of the Act, and may be cited as the Stopping-up of Highways (London Borough of Hammersmith and Fulham) (No 1) Order 2002.
