THE EUROPEAN UNION EXTRADITION REGULATIONS 2002

Notice is hereby given that the European Union Extradition Regulations 2002 (SI 2002/419) shall come into force on 20 March 2002. The United Kingdom (a) Declares that from that date the terms of the Convention on Simplified Extradition Procedure Between Member States of the European Union shall apply in its relations with Member States in respect of which that Convention is in force either generally or between the Member State in question and the United Kingdom subject to such reservations, declarations and statements as are set out in Schedules 2 and 4 to the above Regulations or are later notified in this Gazette; and (b) declares that from that date the terms of the Convention Relating to Extradition between Member States of the European Union shall apply in its relations with Member States in respect of which that Convention is in force either generally or between the Member State in question and the United Kingdom, subject to such reservations, declarations and statements as are set out in Schedules 6 and 8 to the above Regulations or are later notified in this Gazette. Note: The 1995 Convention on Simplified Extradition Procedure comes into force 90 days after its ratification by the last Member State. Prior to that point, it can be applied between individual states, which have made the appropriate declaration under Article 16.3 of the Convention. As at 20 March 2002, the Convention has not come into force in its entirety but applies between the United Kingdom and the following states: Austria, Denmark, Finland, Germany, Greece, Luxembourg, Netherlands, Spain, Sweden and Portugal. The application of this Convention to the remaining states (Belgium, France and Italy) together with their respective reservations, declarations and statements will be notified in this Gazette. The 1996 Convention Relating to Extradition between Member States of the European Union comes into force 90 days after notification by the last Member State that it has completed the constitutional procedures for the adoption of the Convention. Prior to that point, it can be applied between individual states which have made the appropriate declaration under Article 18.4 of the Convention. As at 20 March 2002, the Convention has not come into force in its entirety but applies between the United Kingdom and the following states: Austria, Belgium, Denmark, Finland, Germany, Greece, Luxembourg, Netherlands, Spain, Sweden and Portugal. The application of this Convention to the remaining states (France and Italy) together with their respective reservations, declarations and statements will be notified in this Gazette.
