NOTICE UNDER SECTION 38
WITHDRAWAL OF SUPPORT—RENISHAW RECLAMATION SCHEME—CM/M/359/CA

1. This notice relates entirely to the existing planning application by H J Banks & Company Limited to undertake additional coal extraction at the Renishaw Reclamation Scheme as submitted to Derbyshire County Council on 8 June 2001. 2. This notice relates to the proposed extraction of coal from within the application site boundary by auger machine. The land to which this notice applies is identified on submitted drawing number HJB/359/PA04a—Further Coal Extraction Areas at Renishaw Reclamation Scheme, which is deposited at the Eckington Civic Centre, Eckington, Derbyshire, together with an assessment by Wardell Armstrong of the likelihood of any subsidence arising from auger mining. These documents are available for inspection between the hours of 8.00 am and 5.00 pm, Monday to Friday, except public holidays. In addition, further copies of the drawing and Wardell Armstrong’s assessment can also be obtained from the Company’s Chesterfield office at Alexander House, Mansfield Road, Corbriggs, Chesterfield S41 0JW. 3. The Wardell Armstrong assessment referred to in paragraph 2 above, concludes that in practice, the likelihood of any subsidence arising from the proposed auger mining is minimal. Not withstanding this conclusion it is a statutory requirement for such proposals to be subject to a notification under section 38 of the 1994 Act. 4. H J Banks & Company Limited whose registered office is at West Cornforth, Ferryhill, County Durham DL17 9EU, has the approval of the Coal Authority for the giving of such a notice relating to the land in question. 5. H J Banks & Company Limited hereby give notice that there are proposals to undertake auger mining operations which may require the exercise, in relation to the land identified on drawing number HJB/359/PA04a, of such a right as is mentioned in section 38(1) of the Coal Industry Act 1994, namely to withdraw support from any land to which the section 38 applies.
