THE SUTTON (WAITING AND LOADING RESTRICTION) (NO. 1) (AMENDMENT NO. 25) EXPERIMENTAL ORDER 2001
RELATING TO MARLBOROUGH ROAD—DIBDIN ROAD AREA

Notice is hereby given that the Council of the London Borough of Sutton made the above-mentioned Order, on 8th January 2001, under sections 9, 10 and 124 of, and Part IV of Schedule 9 to, the Road Traffic Regulation Act 1984, as amended by the Local Government Act 1985 and the Road Traffic Act 1991. The principal objective of the Order is to stop obstructive parking to improve access for the emergency services and reinstate the bus service. The Order is being introduced on an experimental basis in order that the effectiveness of the restrictions may be assessed in the light of operational experience. The general effect of The Sutton (Waiting and Loading Restriction) (No.1) (Amendment No. 25) Experimental Order 2001 will be to: (a) increase the extent of the waiting restrictions “no waiting at any time” for the lengths of road specified in Schedule 1 to this notice; (b) introduce waiting restrictions “no waiting at any time” for the lengths of road specified in Schedule 2 to this notice; (c) introduce waiting and loading restrictions “no waiting or loading/unloading between the hours of 7 a.m. and 8 p.m. on Mondays to Saturdays inclusive” for the length of road specified in Schedule 3 to this notice; and (d) introduce loading restrictions “no loading/unloading at any time” for the lengths of road specified in Schedule 4 to this notice. Full details of the proposals, which will come into operation on 22nd January 2001, are contained in the following documents: (a) the Order, (b) a plan indicating the location and effect of the restrictions; and (c) the Council’s statement of reasons for making the Order. These may be examined until the date on which the Order ceases to have effect at Civic Offices, St. Nicholas Way, Sutton, 9 a.m. to 5 p.m. Monday to Friday, and Environment and Leisure, 24 Denmark Road, Carshalton, 9 a.m. 5 p.m. Monday to Friday. The Order provides that, in pursuance of section 10(2) of the Road Traffic Regulation Act 1984, the Executive Head of Planning and Transportation of the London Borough of Sutton, or other person authorised in that behalf by that Officer may, if it appears to that Officer or to that person essential in the interests of the expeditious, convenient and safe movement of traffic, or of the provision of suitable and adequate parking facilities on the highway, or for preserving or improving the amenities of the area through which the roads affected by this Order run, modify or suspend this Order or any of its provisions save that no modification shall make an addition. If the provisions of the Order continue in operation for a period of not less than 6 months, the London Borough of Sutton will consider in due course whether the provisions of the Order should be reproduced and continued in force indefinitely by means of an Order under section 6 of the said Act of 1984. Persons desiring to object to the making of such an Order for the purpose of such reproduction and continuation in force may, within the period of 6 months referred to above (i.e. by 22nd July 2001), send a statement in writing of their objection and the grounds of that objection to the address below, quoting Ref. WL297. Persons objecting to the making of such an Order should be made aware that in view of the Local Government (Access to Information) Act 1985, this Council would be legally obliged to make any comments received in response to this notice open to public inspection, if requested. If any person wishes to question the validity of the Order or of any of its provisions on the grounds that they are not within the powers conferred by the Road Traffic Regulation Act 1984, or that any requirement of the said Act of 1984 or of any Instrutment made under the said Act of 1984 has not been complied with, that person may, within 6 weeks from the date on which the Order is made, apply for the purpose to the High Court.
