THE STOPPING-UP OF HIGHWAYS (PEN-RHIW-BENGI LANE, OAKDALE, CAERPHILLY) ORDER 199 

The Secretary of State for Wales hereby gives notice that he proposes to make an Order under section 247 of the Town and Country Planning Act 1990, to authorise the stopping-up of the length of highway described in Schedule 1 to this notice.
If the Order is made, the stopping-up will be authorised only in order to enable the development described in Schedule 2 to this notice to be carried out in accordance with planning permissions granted by Islwyn Borough Council, on 14 September 1994, under reference 2/11988 and by Caerphilly County Borough Council, on 9th April 1998, under reference P/98/0127. The proposed Order shall cease to have effect upon the cessation of the planning permissions.
The proposed Order requires the provision of new highway which will be highway maintainable at public expense, for which Caerphilly County Borough Council shall be the Highway Authority.
During the 28 days from 21st May 1999, copies of the draft Order and the deposited plan may be inspected, free of charge, during normal office hours at the offices of Caerphilly County Borough Council, Civic Centre, Pontilanfraith, Blackwood or may be obtained, free of charge, from the address below quoting the Welsh Office reference.
Within the above-mentioned period of 28 days any person may, by notice to the Welsh Office Highways Directorate, Roads Administration Divison 3, Cathays Park, Cardiff CF1 3NQ (quoting reference ZC 610-50-57-1) object to the making of the Order. In the preparation of an objection it should be borne in mind that the substance of any objection or representation may be communicated to other people who may be affected by it.

Highway at Oakdale in the County Borough of Caerphilly and comprising:

Description of the length of highway to be stopped up under this Order

A 90 metre length of Pen-Rhiw-Bengi Lane which extends from a point (annotated A on the deposited plan) 290 metres north of its junction with the B4251 road, in a northerly direction to its junction with the former Oakdale Colliery access road (annotated B on the deposited plan).

Description of the new highway to be provided

A 420 metre length of all purpose highway with a maximum width of 7.3 metres and extending from a point (annotated C on the deposited plan) 25 metres west of the terraced properties on the north side by Syr Dafydd Avenue, Oakdale, in a northerly direction for a distance of 420 metres before connecting with a new highway system within the Oakdale development site (annotated D on the deposited plan).
