BULLSMOOR LANE-INTRODUCTION OF BUS LANES AND ADDITIONAL BUS STOP CLEARWAYS. CHANGES TO WAITING AND LOADING RESTRICTIONS AND THE REMOVAL OF A SCHOOL ENTRANCE MARKING

Notice is hereby given that the Council of the London Borough of Enfield on 22nd
March 1999 made:
(a) the Enfield (Bus Lane) (No. 1) Traffic Order 1999;
(b) the Enfield (Restriction of Waiting on Bus Stops) (Special Parking Area) (No.
1, 1997) (Amendment No. 17) Traffic Order 1999;
(c) the Enfield (Prohibition of Stopping Outside Schools) (Special Parking Area)
(Amendment No. 3) Order 1999;
(d) the Enfield (Waiting and Loading Restriction) (Special Parking Area) (Amendment
No. 138) Order 1999;
under sections 6 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation
Act 1984, as amended by the Local Government Act 1985 and the Road Traffic Act 1991.
2. The general effect of the Bus Lane Order will be to prohibit all vehicles from
being in the areas of carriageway (to be known as “the bus lanes”) lying within or
adjacent to the lengths of Bullsmoor Lane specified in Schedule 1 to this notice and:
(a) between the north-eastern kerb-line of that road and a longitudinal white single
line marked on the carriageway of that road, between 7 a.m. and 7 p.m. Mondays to
Saturdays inclusive;
(b) between the south-eastern kerb-line of that road and a longitudinal white single
line marked on the carriageway of that road, between 7 a.m. and 7 p.m. Mondays to
Saturdays inclusive;
3. The prohibitions referred to in paragraph 2 above will not apply to:
(a) a bus; or
(b) a pedal cycle; or
(c) a licensed taxi;
(d) a dial-a-Ride vehicle;
(e) a vehicle being used for ambulance, fire brigade or police purposes if it is
reasonably necessary for that vehicle to be in either bus lane; or
(f) any vehicle being used in connection with the removal of any obstruction in either
bus lane;
(g) any vehicle being used for purposes in connection with the statutory powers or
duties of a local authority or the supply of gas, water or electricity, or in connection
with any building operation, demolition or excavation in or adjacent to either bus
lane, provided that in all the circumstances it is reasonably necessary for the vehicle
to be in either bus lane; or
(h) any vehicle which bears the Royal Mail livery:
(i) while postal packets addressed to premises adjacent to either bus lane are being
unloaded from that vehicle or, having been unloaded therefrom, are being delivered;
or
(ii) while postal packets are being collected for loading on the vehicle from premises
or posting boxes adjacent to either bus lane or, having been so collected, are being
loaded thereon;
(i) any vehicle in either bus lane for the sole purpose of waiting for as long as
may be necessary to enable a person suffering from any disability or injury (including
blindness) which seriously impairs his ability to walk to board or alight from that
vehicle; or
(j) any vehicle in either bus lane:
(i) from any vehicular accessway or crossing over the footway adjoining either bus
lane if that vehicle forthwith leaves the bus lane at a point opposite that vehicular
accessway or crossing;
(ii) from any part of Bullsmoor Lane which does not comprise either bus lane at a
point opposite any vehicular accessway or crossing over the footway adjoining the
bus lane if that vehicle forthwith enters that vehicular accessway or crossing;
(k) any vehicle if the driver thereof is obliged to be in either bus lane in order
to avoid an accident and forthwith causes that vehicle to leave the bus lane; or
(l) any vehicle if the driver thereof is required by law to stop and as soon as reasonably
practicable thereafter causes that vehicle to leave either bus lane; or
(m) anything done:
(i) with the permission or at the direction of a police constable in uniform or a
traffic warden;
(ii) in accordance with any prohibition, restriction or requirement indicated by
traffic signs placed on the highway by or on behalf of the Metropolitan Police.
4. The general effect of the restriction of waiting on bus stops Order will be to
prohibit vehicles from stopping at any time throughout the week on the areas of carriageway
of the street specified in Schedule 2 to this notice and which areas will be marked
on the carriageway by yellow “bus stop” markings and by a solid yellow line within
those markings;
5. The prohibitions referred to in paragraph 4 above will not apply:
(a) to a bus, whilst picking up or setting down passengers; or
(b) to a taxi, whilst picking up or setting down passengers; or
(c) to a vehicle being used for ambulance, fire brigade or police purposes; or
(d) in certain circumstances, to a vehicle being used in the service of a local authority,
to a vehicle being used in connection with building operations, etc., adjacent to
the bus stop or the removal of any obstruction to traffic or the repair, etc., of
the highway or of any service therein; or
(e) where the person in control of the vehicle is required by law to stop, or does
so in order to avoid an accident; or
(f) to anything done with the permission of a police constable in uniform, a traffic
warden or a parking attendant.
6. The general effect of the prohibition of stopping outside schools Order will be
to amend the Enfield (Prohibition of Stopping Outside Schools) (Special Parking Area)
(No. 1) Order 1995, so that the restrictions imposed by that Order which apply in
the length of Bullsmoor Lane specified in Schedule 3 to this notice will be revoked.
7. The general effect of the waiting and loading restriction Order will be further
to amend the Enfield (Waiting and Loading Restriction) (Special Parking Area) Order
1994, so that:
(a) waiting by vehicles including for the purpose of delivering or collecting goods
or loading or unloading a vehicle will be prohibited between 7 a.m. and 7 p.m. Mondays
to Saturdays inclusive, in the lengths of streets specified in Schedule 4 to this
notice;
(b) the sale or offer for sale of goods from a vehicle in the lengths of streets
referred to in sub-paragraph (a) above will be prohibited, except on a Sunday, unless
there is in force a valid licence issued by the Enfield Borough Council or the goods
are immediately taken into or delivered at premises adjacent to the vehicle from which
the sale is effected;
(c) the use of any vehicle or of any animal or the wearing of fancy dress or other
costume, wholly or mainly for the purpose of advertising in the lengths of streets
referred to in sub-paragraph (a) above, will be prohibited.
8. The prohibitions referred to in paragraph 7(a) above will not apply in respect
of anything done with the permission or at the direction of a police constable in
uniform, a traffic warden or a parking attendant or in certain circumstances, e.g.,
the picking up or setting down of passengers; the carrying out of statutory powers
or duties; the taking in of petrol, etc., from roadside petrol stations; to licensed
street traders, etc.
9. A copy of each of the Orders, which will come into operation on 26th April 1999,
of maps indicating the location and effect of the Orders, of the Council’s statement
of reasons for proposing to make the Orders and of the Enfield (Restriction of Waiting
on Bus Stops) (Special Parking Area) (No. 1) Traffic Order 1997, the Enfield (Prohibition
of Stopping Outside Schools) (Special Parking Area) Order 1995 and the Enfield (Waiting
and Loading Restriction) (Special Parking Area) Order 1994 (and of the Orders which
have previously amended those Orders) can be inspected at the Reception Desk, “B”
Block, the Civic Centre, Silver Street, Enfield, Middlesex EN1 3XD, during normal
office hours on Mondays to Fridays inclusive, until the end of 6 weeks from the date
on which the Orders were made.
10. Copies of the Orders may be obtained from Traffic Engineering, the Civic Centre,
Silver Street, Enfield, Middlesex EN1 3XD.
11. Any person desiring to question the validity of any of the Orders only or of
any provision contained therein on the grounds that it is not within the relevant
powers of the Road Traffic Regulation Act 1984, or that any of the relevant requirements
thereof or of any relevant regulations made thereunder has not been complied with
in relation to any of the Orders may, within 6 weeks of the date on which the Order
was made, make application for the purpose to the High Court.

Schedule 1
Bus Lanes—7 a.m. to 7 p.m., Mondays to Saturdays inclusive
Bullsmore Lane:
(a) the north-east side, between the common boundary of Nos. 107 and 109 Bullsmore
Lane and a point 3.3 metres south-east of the north-western wall of No. 53 Bullsmoor
Lane;
(b) the south-east side, between a point 8.5 metres south-west of the common boundary
of Nos. 143 and 145 Bullsmoor Lane and a point opposite the north-eastern boundary
of No. 1 Bullsmoor Ride.

Bus Stop Clearways—At Any Time throughout the week
Bullsmoor Lane:
(a) the north-east and north-west side:
(i) from a point 14.5 metres north-east of a point opposite the north-eastern wall
of No. 235 Bullsmoor Lane north-eastward for a distance of 19 metres;
(ii) from a point 0.7 metres north-west of a point opposite the party wall of Nos.
91 and 93 Bullsmoor Lane south-eastward for a distance of 19 metres;
(iii) from a point 1.7 metres north-west of a point opposite the party wall of Nos.
27 and 29 Bullsmoor Lane south-eastward for a distance of 23 metres;
(b) south-east and south-west side:

Bullsmoor Lane:
(a) the north-east side, between a point 20.50 metres north-west of the common boundary
of Nos. 109 and 111 Bullsmoor Lane and a point 3.3 metres south-east of a point opposite
the north-western wall of No. 53 Bullsmoor Lane;
(b) the south-east side, between a point 21.5 metres north-east of the common boundary
of Nos. 143 and 145 Bullsmoor Lane and a point opposite the north-eastern boundary
of No. 1 Bullsmoor Ride.
Langdale Gardens, between the north-eastern kerb-line of Bullsmoor Lane and a point 10 metres north-east
of that kerb-line.
Note. The Council gave notice of its intention, 6th January 1999, to introduce waiting
restrictions, bus stop clearways and bus lanes in Bullsmoor Lane and to revoke a school
entrance marking in Bullsmoor Lane. Following objections and a petition which were
considered by the Council; the Council decided on 18th February 1999, to proceed with
those proposals with a modification to the waiting restrictions. Therefore Orders
have been made in respect of the proposals and the modification.
